Once you confirm your reservation, your broker will process your payment.

  • If you are booking for a single day and your reservation is confirmed more than 7 days in advance, a deposit of either $1,000 USD or 50% of the total cost of the reservation (whichever is greater) is processed immediately in order to hold the yacht. Once your embarkation date is 7 days away, the remainder of the amount due is processed.
  • If you are booking for a single day and your reservation is made 7 days or less in advance, the total price of your reservation is processed immediately.
  • If you are booking for a multi-day charter and your reservation is confirmed more than 30 days in advance, a deposit of 50% of the cost of the yacht is processed immediately in order to hold the yacht. Once your embarkation date is 30 days away, the other 50% is collected for the price of the yacht, plus the APA, plus the taxes due.

Terms of refunds are dictated by the Charter Agreement. Generally, once a payment is collected, it is non-refundable. In certain circumstances, as dictated by the Charter Agreement, credits can be provided so you will be able to enjoy your yacht charter at a future date that is convenient for you.

The 10 Most-Exciting Yacht Debuts at the Palm Beach International Boat Show

Palm Beach International Boat Show

For superyacht shoppers, the Palm Beach International Boat Show, kicking off its four-day run this week, is set to break records with more than 60 yachts over 100 feet long on display. Last year was also a banner year for superyachts at the show. 

Headliners will include the likes of the 295-foot Corsair Nero ,  the 278-foot Victorious by AKYacht, the 230-foot Turquoise-built Talisman C , and 213-foot Benetti Triumph among brokerage yachts, and in new yachts, the 113-foot Ocean Alexander Puro 35 is making its world debut.  

There are so many gleaming white vessels over 100 feet, in fact, that the fleet will be split between the Palm Harbor Marina at the main show site on the downtown West Palm Beach waterfront and the Safe Harbor Rybovich Marina two miles north. 

Now in its 42nd year, PBIBS will also showcase hundreds of models of dayboats, cruisers, and fishing boats, as well as marine accessories. Running from this Thursday through Sunday, the show coincides with the Palm Beach Modern + Contemporary art show, a fortuitous opportunity for yacht owners wanting to add new art to their collections.

Here are 10 must-see boats at this year’s show.

Corsair Yachts ‘Nero’

The undisputed star of this year’s Palm Beach show? That would be the 295-foot, classically styled superyacht Nero , built in 2007 and inspired by American financier J.P. Morgan’s legendary 1930s steamer Corsair IV . Nero ‘s attendance at PBIBS marks its return to the charter market after an extensive refit in 2021. Now better than new, the boat is being managed by Burgess. With weekly charter rates from $497,000, the vessel offers five-star accommodations for 12 guests in six cabins, with pampering from a crew of 20. Part of the refit included a full interior refresh by Italian interior designer Laura Pomponi, plus a major focus on wellness. That meant the construction of a new, state-of-the-art gym and spa, the assistance of a certified onboard trainer, a masseuse and beautician. After PBIBS, Nero will spend the winter in the Caribbean before returning to the Med for the summer season.

Ocean Alexander Puro 35P

Ocean Alexander is debuting the first of its new Puro superyacht series at PBIBS. The 113-foot Puro 35P comes from the drawing board of Italian designer Giorgio M. Cassetta and is a step back from the polarizing lines of OA’s recent Revolution and Explorer series with their bold, vertical bow designs. Aimed at long-distance cruising, the 35P can carry over 5,000 gallons of fuel and is powered by twin 2,000 hp MAN V12s for a 24-knot top speed. Twin 55kW Kohler generators can also keep the yacht powered at anchor for long periods. Other standout features include extensive glazing in the chiseled fiberglass hull, a forward deck plunge pool, and spacious accommodations for 10 guests.

Think of it as the “starter” Sirena. Aimed at a younger demographic, the Turkish builder’s brand-new Sirena 48 is making its U.S. debut at PBIBS after a global reveal at last fall’s Cannes boat show. Such is its appeal that 27 hulls have already been sold, with 13 of the orders coming from North America. Looking like a scaled-down version of Sirena’s popular 58, its distinctive, trawler-style lines are from Argentinian designer Germán Frers. With more interior space than a typical 48-footer, the yacht offers three staterooms—plus a crew cabin—a spacious, light-filled salon, a large cockpit, an oversized flybridge, and a vast forward social area. Take your pick from twin 550 hp Cummins QSB, or 670 hp Volvo D11 turbo diesels. Or the builder is also offering hybrid power with twin 285 hp electric motors charged up by variable-speed generators that are good for a 30-mile battery-only range.

Feadship ‘Olympus’

Picture purchasing a classic 180-foot Feadship superyacht, and then getting a $10 million bill for a major refit. That was the case with Olympus , built by the Dutch masters at Feadship in 1996 to a design by Britain’s Andrew Winch and the celebrated naval architect Frits De Voogt. Sold in 2022, the new owner sent it to the Monaco Marine refit center in La Ciotat, France for a major makeover. It included overhauling the 2,600 hp Caterpillar engines and generators, repairs to the structure, substantial upgrades to the guest areas and crew quarters, and new paint throughout. With the work completed just last year, the vessel is said to be in mint condition. Offered jointly by brokers Fraser and Edmiston, Olympus has an asking price of $28.5 million. With accommodations for 16 guests in eight cabins, the boat’s highlights include two primary suites, tropical-spec air conditioning, and Palm Beach-chic decor.

Benetti ‘Triumph’

Italian yachting powerhouse Benetti is showing off its superyacht-building skills with the 213-foot Triumph . Delivered in 2021, this Giorgio M. Cassetta-designed steel-and-aluminum world girder features six decks, a 1,400-square-foot primary suite with outdoor terrace and adjoining lounge, a 750-square-foot beach club, and a touch-and-go helipad. What sets Triumph apart, however, is its lavish interior furnishings put together by the owner along with Benetti Interior Style and Monaco-based Green & Mingarelli Design. It includes pieces by French glassmaker Lalique, marble from Marfil, Statuario and Armani, furs, silk and wool carpets, plus a collection of cool black-and-white wildlife photographs by British fine art photographer David Yarrow. The pièce de résistance? That would be the owner’s Triumph Bonneville motorcycle displayed in the salon.

Fjord 39 XP/XL

Germany’s Fjord Yachts, part of the Hanse Group, has a new 39-foot day boat that it’s unveiling at the Palm Beach show. The 39 XP and XL keep all the bold design cues of the bigger Fjord 41 XP and XL, like a big, open cockpit, walkaround center console, vertical bow, mile-high windshield and stretched hardtop. As for the differences between the XP and XL, it’s all about power. The XL comes with a choice of twin 320hp Volvo D4 diesels, or bigger 440 hp D6 versions, both with Volvo stern drives. Likely more appealing to U.S. buyers will be the XP powered by twin 400 hp Mercury Verado V10 outboards giving a 50-knot top speed. Pricing starts at around $500,000.

Turquoise ‘Talisman C’

Chandeliers don’t come more dramatic than this. Cascading down the central spiral staircase of the Turkish-built, 231-foot superyacht Talisman C , this jaw-dropping piece of art comprises an array of multi-colored glass balls threaded on stainless-steel rods and illuminated by hanging fiber-optic strands. It’s the creation of Prague-based Crystal Caviar and is one of a number of glass installations on this sleek, low-profile superyacht. Built in 2011 by the Proteksan Turquoise shipyard, Talisman C was designed inside and out by London-based studio H2 Yacht Design, with naval architecture by Italy’s Hydro Tec. With cabins for 12 guests, one of its highlights is a huge primary suite, which boasts more crystal chandeliers and a private library. Twin 2,447 hp Caterpillar diesels give a top speed of 18 knots and a transatlantic range of 7,000 nautical miles at 12 knots. It’s listed with Burgess for $59.9 million. 

Sanlorenzo 44 ‘Kamakasa’

Delivered in 2020 and sold to a new buyer just last August, the 146-foot Sanlorenzo 44 Alloy Kamakasa will be for sale at PBIBS. The asking price, through the Italian Yacht Group, is $23.75 million. Lack of use might also be the issue here; the yacht’s twin 2,600 hp MTU V16 diesels have a mere 289 hours on the clock. Built in aluminum to a design by Rome-based Zuccon International Project, Kamakasa was the second hull in the Sanlorenzo 44 Alloy series. One of the top features is a primary suite that spans three levels and almost 1,600 square feet; it also comes with a private Jacuzzi, separate bathrooms, a walk-in closet, and a private study. The yacht’s lightweight construction and MTU power combine to deliver an impressive 20-knot top speed.

Bahama 41 GT2

As ultimate, reel-’em-in, fishing center consoles go, the Bahama 41 from West Palm Beach-based Bahama Boat Works is as hard-core as they come. But when owners kept asking for a little more comfort for the family, the builder responded. The result is the brand-new flagship 41 GT debuting at PBIBS. While the proven, wave-slicing hull stays the same, the cockpit layout is new. In place of the single bench seat, there are now three-across bucket seats with a second row behind. The wider console now has space for a pair of 22-inch Garmin screens, while the new extended hardtop features sun shades and even a rain shower. Outboard choices stay the same with either twin Mercury V12 600s, or four 400 hp Mercury V10s, good for a 65-knot-plus top speed. Pricing is from around $920,000.

Heesen ‘Book Ends’

Launched in 2022, this 164-foot Heesen is part of the Book Ends collection, owned by an American couple who have had more than 18 yachts with the same name. The exterior design of this Heesen was by Omega Architects, while Dutch studio Van Oossanen did the naval architecture. The yacht is part of Heesen’s fast cruising series, which is more efficient than other vessels its size, and can reach 23 knots at full speed with its MTU 16V 4000 M65L engines. The yacht is listed through Ocean Independence for 42 million Euro, or about $45.7 million.

Palm Beach International Boat Show returns to West Palm Beach waterfront

The Palm Beach International Boat Show returns this week with more nearly 1,000 vessels on display, including super yachts from around the world.

Tickets are on sale now for the show that runs March 21-24 along the West Palm Beach waterfront.

The show, which started in 1982, has grown to a major economic engine for the community, with last year's impact estimated at $1.05 billion statewide — nearly as much as the $1.3 billion Miami International Boat Show, said Alyssa Freeman, executive director of the Marine Industries Association of Palm Beach County, which owns the boat show.

"Palm Beach is really not that far behind Miami, and Miami is the biggest in the world," Freeman said. "That was really exciting."

This year's boat show features an expanded Super Yacht Show at Palm Harbor Marina, showcasing yachts that typically stretch longer than 80 feet and have a variety of luxurious amenities that include hot tubs, crew quarters, dance floors and sun decks.

"We have more super yachts there than we ever have before, and they're even bigger," Freeman said, noting that at 236 feet, the vessel Casino Royale takes the title of largest yacht at this year's show. The title of "most expensive yacht" goes to Come Together, a 196-foot vessel priced at $59.95 million.

"Everybody, when they think about super yachts, they think about Monaco and Miami, but Palm Beach is a real player in these boat shows and the yachting world," Freeman said.

Exhibitors continue to be drawn to the Palm Beach International Boat Show by the opportunity for high sales year after year when compared with other South Florida boat shows, she said.

"I've heard from several of them, this is their favorite show to attend," Freeman said, "And that's why, because their sales are higher at Palm Beach."

The show continues to make headway in improving its sustainability efforts, she said. After reducing single-use plastics, a major change this year is the addition of water bottle refilling stations throughout the show, Freeman said.

"I think that's exciting because everybody's talking about sustainability and how we can be more sustainable," she said. "Every year, we take little steps to be more sustainable."

Freeman said she is excited for this year's AquaZone presented by Nautical Ventures. The attraction showcases some of the "yacht toys" that are new or popular on the market.

"It's so cool, because there are people actually in the water demoing yacht toys, and it's usually the latest and greatest," she said. "There's always something new every year that we've never seen before."

The Palm Beach International Boat Show also features a range of seminars, demonstrations and discussions throughout the weekend, including mental health in yachting, tips to boat to the Bahamas, safe boating to protect sea turtles and how to address active threats and piracy.

Freeman, who has children, said she loves the Kids Fishing Clinics scheduled for noon and 2 p.m. Saturday and Sunday with captain Don Dingman.

"Captain Don has been doing this for years, and he does a fantastic job," Freeman said. "The kids actually get to go home with a free rod and reel once the clinic is over."

The association produces the Palm Beach International Boat Show with Informa Markets' U.S. Boat Shows division.

"As we gear up for the 2024 Palm Beach International Boat Show, we are excited for our return to Downtown West Palm Beach to celebrate the rich history of this esteemed event," Andrew Doole, president of U.S. Boat Shows at Informa Markets, said in a news release. "Each year, we’re grateful for the warm welcome and support from the community, which truly makes this event a highlight on the calendar for both residents and visitors alike."

Informa also produces the Palm Beach Modern + Contemporary art show happening March 21-24, at the Palm Beach County Convention Center. A Windward VIP ticket to the boat show includes admission to the art show as well.

In addition to serving as a cornerstone festival of spring in West Palm Beach, the boat show launched the Palm Beach International Boat Show Gives Back program to provide hundreds of thousands of dollars in contributions to local nonprofits, Freeman said.

The grant program had a soft launch last year and formalized the boat show's four-decade practice of giving back to the community, Freeman said.

"We're really excited about it," said Freeman, who added that the boat show team is working with the Community Foundation to manage the grant program, which they hope to grow. "That's something that's a super high priority for us."

Money raised through a portion of the boat show's ticket sales, optional add-ons and some related activities goes toward the fund.

The boat show in February announced that the first round of grants totaling $500,000 would go to 25 nonprofits that have marine-related programs or projects, including Florida Fishing Academy, Loggerhead Marinelife Center, Florida Atlantic University, Inlet Grove High School, Palm Beach State College, Sea Turtle Adventures and Friends of Manatee Lagoon.

"We're hoping one day we'll be able to say that it's a million dollars," she said. "So fingers crossed. It relies on the success of the boat show and the support of the community. With that, we will continue to grow."

‘I did what I could': Would-be rescuer speaks as person who fell into Miami River from boat dies

A person who fell from a boat and into the Miami River on Sunday afternoon has died, authorities said Monday.

Miami Police Marine Patrol responded to the scene around 4 p.m. after receiving reports of a woman falling overboard.

Crews were later able to locate him and video from Only in Dade shows them pulling him out of the water. He was then rushed to Jackson Memorial Hospital.

Miami Police confirmed on Monday morning that he did not survive. His identity hasn't been released.

Witness Fernando Veliz spoke with NBC6 on Monday and said he was on a personal watercraft with his girlfriend in the Miami River when he saw people on a boat screaming and pointing at the water. At first he thought it was a dog that ended up in the water.

"When we get around the boat, we see that it's actually a person," Veliz said. "I realize and I was like, she's actually drowning. and I took my vest off and I tried to jump in there to get her."

Veliz said he couldn't reach the woman.

"By the time I was jumping in, she was pretty much, like she couldn't fight any more, and she was starting to sink a bit and that's when I jumped in. I realized she really needed help, she was going to drown for real," he said. "By the time I got to her, she was too deep and I tried to dive under as far as I could but you couldn't see anything under there, all I could see was green."

Veliz said he learned Monday that the person died.

"I know that I did what I could but I wish of course I could have been a little bit faster and maybe we would be having a different type of discussion right now," he said.

What led to him falling overboard and the amount of time he spent in the river remains unclear. Miami Police are investigating.

Miami Beach real estate investor under investigation for firing shotgun from waterfront home

MIAMI (WSVN) - An investigation is underway after a man was seen on video firing his shotgun off a boat at his Miami Beach home.

It was a real blast on Thursday at the high-end Lakeview section on Miami Beach.

Video obtained exclusively by 7News showed the man, identified as Patrick Carroll, firing his shotgun causally on the boat while wearing a “Make America Great Again” hat.

Carroll is real estate investor who lives in a $16.5 million waterfront mansion.

The 44-year-old, according to law enforcement sources, was firing those shots from a boat that was docked at his home.

In a second video, a second long-gun was also seen. The footage was initially posted on Carroll’s Instagram account, which is now being used in an investigation by the Miami Beach Police Department, who learned about the Bayside shooting session by concerned neighbors.

Police told 7News that officers arrived at Carroll’s home Thursday before being told by him that he was only firing blanks. They also said that a second call was made about Carroll over the weekend, but police have not provided those details.

7News went to Carroll’s home Monday afternoon to get his side of the story, but those at his home didn’t say if he was home or if he would comment on the incident.

When crews returned to his home Monday night, two dogs, a doberman and a Belgian Malinois, were released and roamed the neighborhood without any leashes.

Police were called to the scene.

Carroll eventually came out of his home and said that he was firing blanks from the shotgun and that he was making a gun safety demonstration video.

“I was doing a demonstration. I was doing a demonstration on gun safety,” Carroll said. “Using blanks.”

When confronted about the constant police presence at his home, Carroll claimed he has not done anything wrong and left the scene.

On his Instagram account over the weekend, Carroll seemed to address the gun-play.

“I will slow down the posts,” he said. “Most of the negative things out there about me, and, I think, you know, people, you know think badly about me. They just get the wrong impression.”

Carroll has a significant online presence with over a million Instagram followers.

“I’m a loud guy, I’m 6’4, 220 [pounds]. I’m a big guy, right?” Carroll said in an Instagram post. “The mistake I made on Instagram, you know, if you call it a mistake, is just posting too much content. I’m hyper, I’m ADD. It’s just because, my life is [expletive] awesome.”

Carroll has been in trouble with the law in the past. He is being sued for allegedly spitting at a Wynwood restaurant manager’s face.

He also has open criminal cases for battery, which includes a 2022 arrest at Gold Rush gentleman’s club in Miami. 7News obtained surveillance video from the club during that incident. According to police and victims, Carroll was screaming profanities and racial slurs.

Neighbors at the Lakeview community said that they’ve been calling police for several days.

Police told 7News that their investigating remains active.

No arrests have been made and no charges have been filed.

On March 11th, 2023 my husband and I drove over an hour to Miami to see a 60 ft yacht-The Leopard. On March 12th I put down a $1,000 deposit for The Leopard, booked and reserved for May 27th! TWO MONTHS IN ADVANCE! The contract I signed on May 25th was for the 60 ft leopard. On May 26th, I received a call from Juan and Milos stating that the boat I rented may not be available due to an incident that happened with the boat ( ran the ground). However, I was offered a 50 ft boat, in case my original one was not ready to sail. I paid more for the original one. This was a classic bait and switch As of 10 am, the morning of Saturday, May 27th, there was no communication from them, so I had to follow up to see if my original boat was ready. It was such a stressful morning, trying to get some information on my original boat. I had a lot of family in town for my birthday weekend. We were offered two extra hours for the inconvenience. I was told one thing by Golden yacht charter regarding help getting our stuff on the boat and then told another thing by the captain of the boat. After I complained, I was then offered $300 and told that was the best that could be done. I tried calling Juan (the booking agent ) back and did not get an answer, I text and did not get a reply. I started calling all the other numbers for Golden Yacht Charter and did not get an answer. I told the captain we were not leaving and I wasn't signing the final paperwork until I spoke with someone from Golden Yacht Charters, that's when I got a callback. The person I spoke with also tried to lowball me. Again BAIT AND SWITCH! The boat did not leave until an hour later when we finally agreed on an offer. As a company, If you do not have what the customer paid for, you should give them something comparable or better. Not something of lesser value.  I had no issues getting in touch with Juan prior to May 27th. He was responsive and helpful. Email sent to the executive team on June 2nd. Waiting for a response

Had a blast this weekend. Our ship crew Pedro and Andres were the best. They took care of my guest and I. Their customer service was great. The Yacht was beautiful and they made the experience a 10 out of 10. Thank you and I would highly recommend using this company and crew again.

We booked a beautiful 65' azimut and I paid and planned a month in advance. That morning they switched the yacht and the location for pick up. 45 mins- 1 hour away. The charter was not as planned. The caterer was a big waste of money. $2,400... Half my attendees ended not coming because of location switch. The crew was inexperienced. Never, never again. Don't trust this company !!! The aggravation alone was not worth it. They sent us to a private old house. Not the safe Marina in Miami. They then extorted another $400 from us to be dropped of closer to original starting point. I signed a document where to be dropped off and there was no mention of additional charge at that time. I had to zelle them while we were in middle of water. No choice !! It's not the crews fault it was Golden Yacht Charters fault.

We booked a boat 2 months in advance and booked another boat with the same company to tie up with us. The night before he had boat trouble which we understand but they took us out them made us leave 2 hours early because they had booked another charter!!! We got screwed because of his problems! And well we drove back they were cleaning and hosing the boat off all onto us! So unprofessional! The other captain also was lost and lost a buoy that he couldn't swim after!

I booked the beautiful Marquis yacht through Golden Yacht Charters and was beyond amazed at the service! The yacht was spotless, perfect amount of refreshments, and our captain Tiago and stewardess Keyli were incredible! They toured us all around Miami, pointed out beautiful celebrity houses, took us to the best photo op spots, and let us hop in the water whenever we wanted to jump in! I couldn't find anything to complain about even if I wanted. The experience from booking to payment to cruising around was so easy and seamless. I read a lot of negative reviews for other rental companies, was referred to them and I'm so happy we used them! You can't go wrong with them! If you want a premier, luxury yacht experience this is the company you want to book with!

Don't normally write bad reviews but the yacht was dirty and not really what we were expecting. After hearing what our friends paid elsewhere, we definitely overpaid.

This was a terrible experience!!! We booked our boat two months ago and last minute he told us that we had to leave at four instead of six!! Ruined our time and lied to us about the time we have. They were also cleaning the boat as we leave to make sure it's ready for the next group!!! So disrespectful and ruined our day!!! Not worth money!!!

Cruised to South Beach from Hallandale today on 97' yacht with 12 Press Agents from NYC who came down on Private Jet. What a beautiful day. The yacht was sparkly and grand....the crew was charming and polite. I don't think it gets any better than this. Thanks Britt! .

Danny made my trip amazing, we chartered the 55' Azimut and we were blown away by the professionalism on the boat, the boat staff was incredible! I will ONLY charter through Danny via Golden Yacht Charters, and you should too. Danny helped with a discounted rate, even though I booked a week before, all drinks are included! The staff pointed out all the luxury houses as we sailed by them, he knew who owned them, the prices, and all the details about them! The staff made great conversation, which I loved. We pulled up to a island and swam to shore half way through our trip, they know the best spots in Miami! If you are looking for a QUALITY, RELIABLE, and AFFORDABLE yacht connection, defiantly consider Golden Yacht Charters, and give Danny a call.

I am a professional yacht stewardess for over 9 years. I was hired by GYC along with a seasoned colleague. I was contacted to do a charter in the Bahamas. We arrived at the vessel around 2pm with the 10 guest charter to begin the following day at 10 am. We found the boat in deplorable condition. Water dripping from the ceilings in multiple locations, carpets pulled back with fans, dirty dishes glasses ashtrays everywhere. 15 bags of dirty laundry. Etc. We found the crew sleeping and what appeared to be an intoxicated state. We looked around and decided this is unsafe and unhealthy. We contacted the GYC and had no response to our decision to leave. We were so lucky to have caught a plane to get back to Florida. They since will not pay for our time or flight expenses. This is such an unprofessional company. Do Not Ever go on one of there vessels. If you cherish your well being.

Is Miami city manager’s furniture saga under ethics review? Here’s what we know

M iami City Manager Art Noriega on Monday told colleagues in an email that he had “engaged” with the county ethics commission about matters pertaining to the potential conflict of interest involving the city’s business with Pradere Manufacturing, a furniture vendor owned by his in-laws that employs his wife. He said the matter was “under review.”

But what exactly did he mean by that?

City spokeswoman Kenia Fallat told the Miami Herald that Noriega had no further comment on the situation. And the Miami-Dade County Commission on Ethics and Public Trust does not publicly confirm or deny the existence of what’s called a “matter under initial review” or a “preliminary investigation” until reaching a conclusion. But a person familiar with the matter told the Herald that the Ethics Commission has opened a preliminary investigation into the situation, which could lead to a potential enforcement action.

In an email to commissioners and the mayor, Noriega on Monday shared a presentation and data, which he later retracted , regarding the city’s purchases with Pradere Manufacturing. The email was a much-anticipated response to concerns about impropriety and a potential conflict of interest after Herald news partner WLRN in January reported that the city had contracts worth over $440,000 with Pradere. The city manager took the opportunity to say that he had “engaged” the Ethics Commission “in alignment with our commitment to ethical governance.”

However, Jose Arrojo, director of the Ethics Commission, told the Herald on Wednesday that he does not recall ever meeting with or speaking to Noriega about the matter. Arrojo did say that Fallat, the head of communications for the city, called him in January “on behalf of Noriega seeking ethics guidance and wanting to come in and speak.” At the time, Arrojo told her that while he appreciated the city manager wanting to come in to speak, he could not give guidance for something that already happened, which is standard practice for the Ethics Commission.

A person seeking an ethics opinion about a potential conflict of interest must do so before engaging in the type of conduct that could be a conflict, Arrojo said.

After speaking with Fallat, Arrojo on Jan. 18 followed up with Noriega in an email explaining why the Ethics Commission could not offer an opinion after the fact, correspondence that was shared Wednesday by Local 10’s Christina Boomer Vazquez on X , formerly known as Twitter.

Noriega did not proactively reach out to the Ethics Commission about the matter after he became city manager in 2020. Instead, he sent a memo to commissioners and Mayor Francis Suarez disclosing that his wife was the chief operating officer at Pradere, “a company that has done business with the city since 2008.” He also wrote that he would recuse himself from “any and all involvement/decision making and/or approvals between the City and the company.”

In WLRN’s initial Jan. 4 story, Noriega said that he made a “decision of choice” not to seek an Ethics Commission opinion because he believed the memo was sufficient.

In addition to providing opinions for elected officials proactively seeking ethical guidance, the Ethics Commission also investigates alleged impropriety. An ethics investigation begins with a review of an allegation of a potential ethics violation to determine legal sufficiency — in other words, would the alleged activity be a violation of the law if it were true?

If an allegation is found legally sufficient, a preliminary investigation is conducted. The process is highly confidential until the preliminary investigation is completed, and as such, investigators cannot publicly confirm whether a situation is being probed as a “matter under initial review” or a “preliminary investigation.” Noriega could request that an investigation become public at any point, however.

Although Arrojo could not confirm or deny whether the matter is under initial review or preliminary investigation, a request was made via NextRequest, the city’s online public records portal, on Dec. 28 from “COE,” a common acronym for the Commission of Ethics, for any public records related to the Pradere company and its subsidiaries from December 2020 through the date of the request.

When asked if the request was made by someone at his office, Arrojo said he had “no reason to doubt the accuracy” but said he couldn’t speak to why his office would have asked for the records. WLRN previously reported that the Ethics Commission began requesting records after being contacted by WLRN journalists ahead of the initial Jan. 4 story.

If Noriega were to come in to speak to the ethics commission, whatever he said could be used in a matter under initial review or a preliminary investigation, Arrojo said.

“If he wants to come in and talk about past conduct, then everything is fair game. And if you admit to something that you did, that you shouldn’t have done, then it’s fair game,” he said.

Noriega’s statement Monday that the matter is “currently under review” by the Ethics Commission would seem to suggest that one of the confidential processes is underway. But Noriega, who touted transparency and accountability in the email he sent Monday, said through Fallat, the city spokesperson, that he had no further comment in response to a reporter’s questions Wednesday. On Tuesday, the city manager canceled a previously scheduled interview with another Herald reporter after walking back the data and presentation his office released. No timeline was given for when accurate data would be released or when he would answer questions from reporters.

City Commissioner Manolo Reyes said Tuesday that he had been waiting for an opinion from the Ethics Commission before weighing in on the issue. Arrojo said he reached out to Reyes’ office Wednesday morning to say that one “would not be forthcoming.”

Speaking to the Herald later, Reyes said he still would like to wait until Noriega delivers his full presentation and for guidance from the Ethics Commission, if there will be a determination after a hypothetical review or investigation.

Reyes said he was most concerned with whether the city manager or his wife profited from the city’s furniture purchases.

New city policy on ethics

Also in his presentation and email Monday, Noriega said he was “pleased to introduce a new administrative policy,” dated March 11, that requires city employees’ conflicts of interest to be discussed at the “next available” city commission meeting and submitted to the Ethics Commission. Additionally, whenever an opinion is given, the city attorney would provide the decision to the commission, according to the policy.

Arrojo said the policy does not materially change the way conflicts of interest are already supposed to be handled in Miami-Dade County.

“Most, if not virtually everything, in the administrative order is already required or prohibited by the county ethics code,” said Arrojo.

What isn’t part of county code, he said, is the public discussion and the dissemination of the ethics opinions by the city attorney. Usually, he said, opinions stay between the employee and the commission, unless it involves someone such as an elected official or department director.
