Judge postpones sentencing

PASADENA ? A Superior Court judge postponed sentencing Friday for a woman who pleaded no contest in January to abusing a Glendale couple’s newborn baby, ruling that the defense needed more time to review the sentencing recommendation from the California Department of Corrections.

Amy Ennis, 31, of Los Angeles, will return to court on May 12 to be sentenced.

She was charged in June with one count of child abuse with a special domestic-violence allegation of causing great bodily injury, Deputy Dist. Atty. Oscar Plascencia said.

Defense attorney James E. Blatt asked Pasadena Superior Court Judge Teri Schwartz to postpone the sentencing because he received the diagnostic report on Thursday.

“I just got it and I want to review it so I can submit my sentencing memorandum,” Blatt said.

Blatt would not divulge what the report from the State Department of Corrections recommended as a sentence for Ennis.

Ennis was arrested on Oct. 14, 2004, on suspicion of severely beating now-21-month-old Joseph Van De Yacht between July and October of 2004, when she was hired to baby-sit him.

Joseph, who was between 3 1/2 weeks and 4 months old at the time of the abuse, suffered numerous injuries including six rib fractures, a fractured leg and skull, hemorrhages in both of his eyes and permanent optical nerve damage, police said.

Depending on what the court decides, Ennis could face probation or up to 12 years in state prison for the charges, said Jane Robison, spokeswoman for the Los Angeles County District Attorney’s Office.

Joseph’s family and police say Ennis deserves prison time based on the injuries Joseph faced.

“He had broken ribs, two broken legs, hemorrhaging ? is that a probation case?” Glendale Police Det. Darrel McEntarffer asked. “I don’t think so. And she admitted to doing all this in court.”

In the seven years McEntarffer has been assigned to cases like the Van De Yacht’s, this is probably one of the worst he’s seen, he said.

“She should get prison time,” he said. “It’s by the grace of God that baby didn’t die.”

The Van De Yachts will invite nearly 100 friends and family to attend the May 12 sentencing, to show support against Ennis, said Joseph’s father, Bernie Van De Yacht.

They expect at least 25 people to show up in court, he said.

Bernie Van De Yacht, his wife, Valerie Van De Yacht, and two other family members will be reading statements on that day.

“I am sick to death of hearing for a year and a half about Amy’s rights,” said Joseph’s aunt, Alison Aldrich. “Joseph’s rights have been swept aside.”

The Van De Yachts said they hope their statements and a strong show of supporters will encourage the judge to give Ennis prison time.

“There’s a lot that hasn’t been said,” Bernie Van De Yacht said. “When you’re in the court system, your hands are tied. They say, ‘Don’t say this, don’t say that.’ This time, we won’t be censored.”
