Accused drunken driver charged with murder in boat club crash that killed 2 children

MONROE COUNTY, Mich. — A Michigan judge on Tuesday ordered that the woman accused of crashing into a boat club over the weekend, killing two children and injuring several others, be held on a $1.5 million bond after hearing from the victims’ family members in court.

Authorities arrested Marshella Marie Chidester, 66, on suspicion of second-degree murder and operating a vehicle while intoxicated after they said she crashed into the Swan Boat Club in Berlin Township on Saturday. At the time, families were gathered to celebrate a 3-year-old’s birthday party at the club, The Detroit News reported .

Two siblings, 8-year-old Lana Phillips and 4-year-old Zayn Phillips, died in the crash, according to the newspaper. About a dozen other people were injured, including the children’s mother, Mariah Dodds, and their 11-year-old brother, the Detroit Free Press reported .

Distraught family members addressed the court during a bond hearing on Tuesday, telling District Court Judge Christian Horkey that Chidester has a history of alcohol abuse and should have never gotten behind the wheel on the day of the crash.

“They walked into their birthday party having a fun time. They were sitting at that table eating and this woman crashed her car through this building, destroying all of our lives,” Raquel Smouthers, Lana and Zayn’s aunt, said through sobs on Tuesday. “Not just my family, everyone else that was in that building. … Nobody should have to go to a birthday party thinking that they’re going to die.”

Monroe County Prosecutor Jeffrey Yorkey asked a judge to hold Chidester on a $1.5 million bond on Tuesday, calling her a “danger to the community” and noting that a preliminary breath test found that her blood alcohol level was “significantly over the legal limit” at the time of the crash.

“A $1.5 million bond in this case is a gift,” he said.

Chidester’s attorney, Bill Colovos, argued in favor of a $100,000 bond, saying that his client had only one glass of wine hours before the crash. He pointed to her lack of a criminal history and suggested that she might have had a seizure while driving.

“This is not a monster,” he said. “It’s horrible what happened, absolutely horrible. … But some things we don’t have control over.”

Yorkey said authorities found no evidence of a possible seizure.

“What’s more is … she indicated herself that she had some seizure issues and she was on some medication and she wasn’t supposed to be drinking, but admitted that she had been drinking that day,” he said.

Colovos told the News on Tuesday that attorneys were awaiting the results of a blood alcohol test. The preliminary breath test Chidester took after the crash is not admissible in court because such tests are often inaccurate, the newspaper reported.

Chidester faces two counts of second-degree murder, two counts of operating while intoxicated causing death and four counts of operating while intoxicated causing serious injury. If convicted of the charges, Chidester could face a maximum sentence of life in prison.

Authorities continue to investigate.

A judge on Tuesday set a $1.5 million bond for a Newport woman charged with eight crimes related to the fatal crash at the Swan Boat Club in Monroe County.

Marshella Chidester stared forward blankly in Monroe County’s district court as Raquel Smouthers, in sobs, recalled the moment she told her sister Mariah Dodds in the hospital that Dodds’ two young children were killed. 

“I had to be the one to tell my sister her babies were gone when they removed her ventilator yesterday. She said: ‘How am I supposed to live without my babies?’ “ Smouthers said in comments permitted by the judge.

Chidester, 66, of Newport, is accused of driving drunk and plowing her SUV into a birthday party Saturday at the club in Newport. Chidester’s lawyer, Bill Colovos, argued that his client suffered seizures in her legs and only had one glass of wine that day. 

Dodds and three of her children were attending the party. Two of Dodds' children, 8-year-old Alanah Phillips and 4-year-old Zayn Phillips, were killed, and over a dozen other people were injured. Dodds and her 11-year-old son survived, but are still hospitalized. Both of the boy's legs and some ribs are broken and his skull is fractured.

In court, Chidester continued to look straight ahead as she sat in her striped jumpsuit and orange slippers, her right arm in a cast. She did not react when Judge Christian Horkey read the charges against her aloud: two counts of second-degree murder, two counts of operating a vehicle while intoxicated causing death and four counts of operating a vehicle while intoxicated causing serious injuries.

Monroe County Prosecutor Jeffery Yorkey asked for a $1.5 million cash bond, pointing to a history of "severe substance abuse" allegedly corroborated by friends and family of Chidester. Judge Horkey agreed to the bond.

Chidester’s arraignment on Tuesday was filled with tense moments as even more members of Dodds’ family and community members, some of whom attended the court hearing virtually on the web, interrupted Colovos, as he spoke on Chidester's behalf.  

Colovos compared the high bond to burning his client at the stake “by just craziness” and “crazy words.”

Horkey also ordered bond conditions should Chidester post bond, including alcohol testing, a tether, and she would be prohibited from drinking or driving. 

Chidester isn’t a monster, Colovos said. She lived a quiet, retired life with her husband right down the road from the club, he said.

Colovos’ theory, he argues, was that Chidester was invited to the birthday party that day and had a seizure on the way to the party. Chidester doesn’t remember what happened and “feels horrible,” he said. He noted that his client has a clean criminal record and no traffic violations. Colovos said they are waiting for tests to determine her blood alcohol levels.

Dodds’ loved ones and community members interrupted Colovos with statements, including “she was drunk.”

The children’s grandmother, Kathy Phillips, spoke as well.

“She took my grandbabies from us,” Phillips said. "She made that choice to go in that car, and she chose to drink and drive.”

The family's lives are destroyed, Smouthers said.

"Nobody should ever have to go to a birthday party thinking that they're gonna die," Smouthers said, who saw her deceased niece and nephew the last moment before the car was removed.

"It's a horrible, dramatic thing. I cannot close my eyes at night without seeing the babies and what they look like," she said.

Chidester had been an officer of the boat club, acting as a commodore for the group. Her mother was a charter member of the club, according to the mother's 2006 obituary. Chidester worked at DTE as a manager at Fermi 2, according to her LinkedIn page and the Monroe News. A spokesperson for the utility said she left that job nine years ago.

Childester’s next court appearances are scheduled for a probable cause conference April 30 and a preliminary examination on May 6.

Zayne, Alanah remembered

Hurt and pain reverberated throughout Horkey’s small Monroe County courtroom. For Nicholas Phillips, the deceased children’s uncle, “there is no justifying what she did to my family,” he said in court via video, referring to Chidester.

Alanah used to watch her dad play basketball, "but now that little girl is not gonna be able to go see it.”

And the child’s father is at the hospital praying that his older son makes it through, Phillips said.

“And he’s still gotta tell his son that he lost his sister and brother. How is that right or how is that even fair? How is it even justified?” Phillips said.

Zayn was about to turn 5.

“We were supposed to be planning a birthday party for Zayn, not a funeral,” Smouthers had said in court. Her own birthday was a few days prior and "the babies were just at my house."

Smouthers said her niece Alanah had "flawless curly hair" and loved to dance. Her nephew, Zayn hated how Smouthers' truck was always dirty, so she cleaned it just for him.

Zayn loved cracking jokes, Smouthers said. Eminem was his idol.

Lawsuit filed against Chidester, bar

On Monday, Dodds and her 11-year-old son, identified as “J.P.” filed a lawsuit against Chidester and Verna’s Tavern, where Chidester was allegedly seen drinking prior to the tragedy, according to the lawsuit.

The lawsuit accuses Chidester of gross negligence.

"Can you imagine anything worse than that as a human being, as a parent?" said Jon Marko, one of Dodds' attorneys.

The lawsuit argues that Verna's Tavern is also liable. The bar allegedly sold Chidester alcohol while she was visibly intoxicated, according to the lawsuit, and she continued drinking until she left the bar and ultimately crashed.Verna's Tavern should have stopped selling Chidester alcohol and should have provided alternate transportation to her home, the lawsuit argues.

A spokesperson for the bar, and Chidester’s attorney, maintains she only had one glass of wine. An attorney for the bar couldn’t be reached Tuesday.

Black's Island is located in Saint Joseph Bay and just south of Port St. Joe on Florida's panhandle. The island was named for Samuel "Black Sam" Bellamy, who is known as the wealthiest pirate in history.

The island hosts its own private resort, complete with 26 waterfront bungalows as well as common areas like a clubhouse, cabana, and pool, according to the sale listing. The structures are connected via an elevated boardwalk that runs along the center of the island.

In addition to listing the entire island for sale, the owner has also listed several of the individual bungalows . Weldon said the owner, Atlanta developer Scott Seymour, is open to selling the entire island or just some of the bungalows — so it will ultimately depend on what potential buyers are interested in.

In this scenario, Weldon said the setup would be similar to a condo homeowners' association. The bungalows, which start at $1.5 million, would be purchased under a 99-year lease, and there would be a $25,000-a-year HOA fee to cover taxes, insurance, repairs, and utilities, including upkeep for all the common areas.

Weldon also said in the case of individual bungalow sales, pre-approved title insurance and lenders have already been set up, so potential buyers would not have to worry about getting insurance — an increasing problem in Florida .

The bungalows, which were first built in 2009, were remodeled when Seymour bought the island in 2018. Weldon said that in addition to renting out the bungalows, he also frequently spends time on the island.

Seymour is also currently building a $20 million hotel on the mainland where anyone who purchases a bungalow will be able to park. The hotel is also set to be named after the infamous pirate and will be called The Bellamy.

The steering station is a traditional raised helm to starboard, and the lounge is just up a few stairs from there. The helmsman is in contact with those in the main cockpit and those in the lounge. Out sailing, we got the 50L up to 10 knots in a good breeze, so the boat is fast. It is also commodious and will make a very comfortable home for a family or a charter party.

Seawind 1600

Multihull impresario, dealer, and broker Phil Berman (The Multihull Company) has sold more multihulls over the last 30 years than just about anyone. His latest project has been the development of the Balance line of performance cruising cats. Aimed at Blue-water sailors looking to sail fast and far, Switch 51 has proved itself and regarded in this day as a remarkable ocean cruising catamaran. This classic high-performance voyage was designed by VPLP and is said to combine a level of comfort, performance, and safety. It was built by Sud Composites in France with high tech materials. Sud initially built about 18 of these classic catamarans from 2001 to 2007.

Switch 51 hulls are built with vinyl ester sandwiched with a Klegecelle PVC foam core, thereby creating a hull light enough to be real quick and heavy enough to handle the ocean waves and swells. The saloon and galley are huge, with the cockpit spacious. The layout and accommodation are perfect for a small family with classic amenities aimed at making your stay on board a memorable one. This also a pretty affordable option in this category with prices on the used market as low as 450k.

Strange Glow Over Moscow Skies Triggers Panic as Explosions Reported

B right flashes lit up the night sky in southern Moscow in the early hours of Thursday morning, new footage appears to show, following reports of an explosion at an electrical substation on the outskirts of the city.

Video snippets circulating on Russian-language Telegram channels show a series of flashes on the horizon of a cloudy night sky, momentarily turning the sky a number of different colors. In a clip shared by Russian outlet MSK1.ru, smoke can be seen rising from a building during the flashes lighting up the scene.

Newsweek was unable to independently verify the details of the video clips, including when and where it was filmed. The Russian Ministry of Emergency situations has been contacted via email.

Several Russian Telegram accounts said early on Thursday that residents of southern Moscow reported an explosion and a fire breaking out at an electrical substation in the Leninsky district, southeast of central Moscow.

Local authorities in the Leninsky district told Russian outlet RBC that the explosion had happened in the village of Molokovo. "All vital facilities are operating as normal," Leninsky district officials told the outlet.

The incident at the substation in Molokovo took place just before 2 a.m. local time, MSK1.ru reported.

Messages published by the ASTRA Telegram account, run by independent Russian journalists, appear to show residents close to the substation panicking as they question the bright flashes in the sky. One local resident describes seeing the bright light before losing access to electricity, with another calling the incident a "nightmare."

More than 10 villages and towns in the southeast of Moscow lost access to electricity, the ASTRA Telegram account also reported. The town of Lytkarino to the southeast of Moscow, lost electricity, wrote the eastern European-based independent outlet, Meduza.

Outages were reported in the southern Domodedovo area of the city, according to another Russian outlet, as well as power failures in western Moscow. Electricity was then restored to the areas, the Strana.ua outlet reported.

The cause of the reported explosion is not known. A Telegram account aggregating news for the Lytkarino area described the incident as "an ordinary accident at a substation."

The MSK1.ru outlet quoted a local resident who speculated that a drone may have been responsible for the explosion, but no other Russian source reported this as a possible cause.

Ukraine has repeatedly targeted Moscow with long-range aerial drones in recent months, including a dramatic wave of strikes in late May.

On Sunday, Moscow Mayor Sergei Sobyanin said the region's air defense systems had intercepted an aerial drone over the city of Elektrostal, to the east of Moscow. No damage or casualties were reported, he said.

The previous day, Russian air defenses detected and shot down another drone flying over the Bogorodsky district, northeast of central Moscow, Sobyanin said.

There is currently no evidence that an aerial drone was responsible for the reported overnight explosion at the electrical substation in southern Moscow.
