We just came back from the ultimate experience with The Moorings. The British Virgin Islands have been on our travel bucket list for many years. From the stunning blue ocean water, to the various islands offering a variety of experiences, there is endless adventure here!

The most popular way to see the British Virgin Islands, also known as the BVI, is by a Yacht Charter. When we received an invitation to do just that with The Moorings we couldn’t say no! Think sun, sand and the ultimate all inclusive experience that’s actually affordable.

In this blog post we are going to be sharing all the information you need to book a Yacht Charter with The Moorings! So let’s get into it.

What To Expect when you Charter a Yacht with The Moorings

Type of Charters Available

The Moorings offer a few different ways to charter a Yacht. If you or someone in your group has a Captain’s License and want to navigate a destination yourself, you can do that! Want to have just a skipper provided, or have a fully crewed Yacht for an all-inclusive experience, that can happen too! There are many options to make your holiday perfect! With the option of a fully crewed Yacht Charter, this means that there is a Captain as well as a Private Chef provided with the Yacht. Meaning you and your group can relax and enjoy the destination without having to worry about navigating the boat, cooking or cleaning. This is the experience that our group had, so this is what we are going to chat about in this blog post today.

Inclusions With A Crewed Charter

The Moorings team truly provides a 5 star experience when it comes to a fully crewed yacht charter. Leading up to the trip our entire group was sent a survey which included some simple questions about preferences for food we like, dietary restrictions, meal sizes we prefer as well as the type of beverages (alcoholic and non-alcoholic) we would like to have on the yacht.

Each day we were served breakfast, lunch and dinner as well as a variety of appetizers in the afternoon. Snacks were also included on the boat to have at any time.

Each Yacht has a slightly different layout, but each bedroom comes with a comfortable bed and an ensuite bathroom for a home away from home feel during your vacation.

If you enjoy water-sports, then you will definitely enjoy having unlimited use of Paddle boards, Kayaks and Snorkeling Fins on board! The BVI is known for its beautiful blue water, so you will be sure to get a lot of use out of all of these.

The crewed yachts offered are either power yachts or sailing yachts. They can hold a variety of group sizes from 2 people all the way up to 10, so you will need to cater your Yacht choice to your group size!

Our Experience With The Moorings

The experience starts when you begin the trip planning process with The Moorings team. Everyone we spoke with was friendly and eager to make this trip perfect for our group. They sent us the pre-departure surveys, general information about the yacht we would be on, and answered any questions that we had regarding our upcoming trip.

We spent 5 days on the luxurious Moorings 5800 Crewed Yacht! This Yacht has two above deck cabins and 3 below deck cabins perfect for groups of up to 10 people. There is a large dining area inside with a fully stocked kitchen. There is an outside dining area at the back of the yacht as well, where we spent almost every meal! Our yacht had two big nets at the front to enjoy the Caribbean sunrise and sunsets. We also spent a lot of time on the top deck where there was another lounge area that gave us a stunning 360 view of our surroundings!

From the moment we arrived on the Yacht, Captain Seymour and Chef Vicki made our group feel welcome. We were excited to depart on this 5 day adventure sailing through the BVI. We did an initial safety briefing, and the Captain showed us around all of the areas of the boat. We then discussed the best plan of action for our itinerary. This was based on the weather and the destinations our group was eager to see.

Throughout the entirety of the trip, our Captain continuously checked in with us to give us updates on our itinerary based on weather. His top priority is safety so he made sure we got to see almost everything we wanted to in the safest way possible. Some highlights for us were the world famous Baths, Saba Rock and the Soggy Dollar!

Chef Vicki ensured that we were well fed for every meal. She truly went above and beyond to make our experience special by catering our meals to our group. She even prepared a birthday cake for a member of our group and stocked on late night snacks like cookies and chips! Chef Vicki also provided turn down service for our rooms each day which is greatly appreciated when you are on vacation.

What Our Days looked Like

Waking up in the morning to views of the Ocean from our cabin was truly the best way to start the day. Some days we even woke up and dove right into the water before breakfast! We also really enjoyed starting our morning with coffee on the top deck of the boat to really take in the beauty of the BVI!

Every stop that we made was so unique. You could truly spend weeks exploring the BVI and still not see everything.However, our group was determined to see as much as we could. So we typically started our mornings quite early to be able to get to our first destination of the day. We definitely recommend adding the Baths and Caves to your BVI itinerary, this place is absolutely spectacular. Another stop was at The Soggy Dollar for a famous Painkiller! However our Captain made us his version, and controversial opinion, we all liked his more HA! However, it is still worth the stop for the incredible beach and to experience this famous spot.

With the water being so blue everywhere we went, we made sure to pull out the paddle boards and kayaks as much as we could! The Moorings team also provides everyone on the boat with flippers for snorkeling, so make sure to pack your mask with you. We saw so many fish at every stop we made, and sea turtles too!

If we were in need of relaxation we made our way to the front nets or the top deck where Chef Vicki or Captain served up some excellent drinks.

Final Thoughts

If you are looking for an unforgettable experience with your friends and family, then we cannot recommend chartering a Yacht with The Moorings enough. Whether you choose to navigate the Yacht yourself, or indulge in the all inclusive fully crewed experience, this is a bucket list trip.

More than a mere catamaran, the astounding Moorings catamaran 5800 is a full-fledged floating holiday resort.

Such an “aha” instant occurred for me. Shortly after taking the wheel of the Moorings 5800 last fall during sea trials on the Chesapeake Bay. From my second-story perch on the vast flybridge of the 58-footer, though the view was expansive, for some reason I’d failed to notice the J/22 we were overtaking when we’d swapped drivers and I’d assumed the helm. But suddenly, the smaller boat was abeam, and its masthead was almost precisely at eye level. It was a strange, even unsettling perspective. READ MORE

Something Wonderful the crewed sailing catamaran based in the Virgin Islands is a Leopard 5800 catamaran that is built by the same company producing the Moorings 5800. These catamarans offer forward cockpits with entrances from both the main deck cabin and the saloon area. Light floods the saloon area bringing the outside in. The fly-bridge is very spacious and the aft cockpit is also offering to cover protection from the sun and possible adverse weather.

Planning your route…..

Below you will find an itinerary which is intended as a guide to help you plan your trip around the British Virgin Islands. It’s good to have an outline of places you would like to go and things you would like to see. However, we do advise you to remain flexible and allow for the unforeseen.

Once you’ve arrived at our base you will receive a full chart briefing, tailor-made to your trip. Moreover, we’ll talk you through all the ‘must-see sites’, things not to miss, and obstacles to avoid. Additionally we’ll fill you in on all our personal favorites! We will give you a good idea of which route to take based on your group, the weather and any events taking place. Of course you’ll need to decide if you want to join in the action or stay away from the crowds.

You will be provided with a ‘Cruising Guide to the Virgin Islands’ and a chart of the local area for use during your trip. A copy of The Cruising Guide can be purchased from CruisingGuides.com or you can receive a free digital version from onlinecruisingguide.com.

SAMPLE ITINERARY FOR THE BVI:

The Bight at Norman Island makes the perfect anchorage to head for on your first night. After crossing Sir Francis Drake Channel you will sail past The Indians and Pelican Island. Dead ahead is a  protected anchorage to grab your first overnight mooring.

The Bight makes such a great first night stop as it is well protected, has loads of moorings, and offers good snorkeling. You’ll also find a lovely restaurant in the left corner called Pirates Bight and the historic Willy T, which is on anchor. Once you are secure on your overnight mooring, jump in the dinghy and make your way over to The Caves. You’ll find a splendid National Park site with natural caves to explore and teeming with sea life, therefore a great first snorkel.

As the sun is dropping in the sky, you’ll want to return to the boat, scrub up and dinghy ashore for dinner. Pirates Bight is a lively, family-oriented beach bar and restaurant. On the other hand, you could opt for the Willy T. This famous floating bar and restaurant made a name for itself many years ago. They offered a free T-Shirt to anyone who jumped off the top deck naked! Health and Safety stepped in to prevent this ritual but it still has a reputation for being fun and noisy. It’s not for everybody but if you are looking to party and have a good time, this a must do.

At first light, motor straight over to the Indians, as it is close enough to leave the sails at rest. Once you’ve picked up a National Park mooring buoy you can leisurely take in the spectacular rock formations before snorkeling. Take in the lavish corals, an array of sealife and colorful sponges which contrast with the rocky ledges and steep walls that rise to the surface.

Next, sail to Great Harbor, Peter Island. Here you will pick up a mooring for the night and either dine at Ocean’s 7 or fire up the BBQ. Peter Island has 5 gorgeous white sand beaches and offers great snorkeling and swimming with turtles popping up throughout. Just off of Key Point you will find one of the newest dive sites, established in 2019, the sunken original Willy T. This an underwater pirate-themed shipwreck playground for divers, complete with skeletal pirates going about their daily business. Don’t miss this one!

Following breakfast, sail to the wreck of The Rhone, sunk in 1867, just off of Salt Island for a stunning morning dive/snorkel. Next, tack up to Cooper Island in the early afternoon and grab your overnight mooring in Manchioneel Bay. Then swim over to Cistern Point for more snorkeling, relaxing on the beach or chillin’ by the bar at the Cooper Island Beach Club. For the evening, you can either dine ashore at the restaurant (be certain to call for reservations) or barbeque on your boat.

*Due to the plentiful turtle grass on the sea bottom, there is a strict ‘no anchoring’ policy in effect at Cooper Island. So be sure to get there early for a mooring or reserve one first thing in the morning.

Get an early start and tack up the Sir Francis Drake Channel to The Baths on the southern end of Virgin Gorda. Once there, pick up a National Parks mooring, dinghy part of way in and tie off at the dinghy line provided. From there you and your crew will need to swim to the beach. Do pay attention to the flag system on the beach  there is a north swell.

You can spend the whole day exploring the tunnels, caves and crystal-clear pools through the maze of massive boulders. By the way, they have been resting here for literally millions of years! Enjoy a little lunch on board before heading back across the channel towards Marina Cay. Although Pusser’s no longer have a presence at Marina Cay, there is still amazing snorkeling and swimming to be had. Another option is to stay at Scrub Island in the resort’s marina and enjoy their fantastic 2 story pool and restaurants.

Today you’ll be heading to North Sound, Virgin Gorda where you will find a little something for everyone. Why not break up your sail with a stop at The Dogs? An excellent snorkeling and diving site as with all National Parks, it is a cluster of three small islets.

After lunch, onward up into the North Sound, being sure to use the well-marked north entrance and not the shortcut next to Mosquito Island. Your destination, Leverick Bay, has everything that a sailor or landlubber could want. The amenities include: a full service spa that can even accommodate you aboard, a complete marina, pool, restaurant, beach bar, live entertainment most nights, water sports, shopping, and a market for provisions plus a deli. In fact, there’s too much to list, definitely worth a stop over!

If weather permits, sail to Anegada early in the morning (leave by 9 AM!), which is an easy 2-3 hour trip from the North Sound due North. Be sure you called the office first to get the OK!

There is only one anchorage and make sure you go in between the red and green entry markers. By the time you’ve picked up one of the 30 mooring buoys, you and your crew will be ready to explore. Choose either a taxi or rented car for the day to visit Loblolly Bay, Cow Wreck and Anegada Beach Club. In addition to the beautiful white beaches, you will fall in love with the Roseate Flamingos, rare rock iguanas, manmade conch islands and splendid plant species like sea lavender. The fantastic outer reef, Horseshoe Reef, is rich in marine life and perfect for snorkeling or diving and dotted with shipwrecks. Anegada is the most scenic watersports playground in the region, especially for kiteboarders and paddle boarders alike.  And for Dinner….? Lobster of course!

As the sun rises get set to sail west, downwind, towards Jost Van Dyke. It’s important to realize that this will be your longest sail, therefore it would be a good idea to stop for a morning snorkel at Monkey Point, Guana Island.

Given that Monkey Point is another national park, you’ll find an abundance of marine life. As a matter of fact, yellowtail snappers, bluestriped grunts and yellow jacks, along with turtles and tarpon call this home. Next, continue to Great Harbor on Jost Van Dyke, home to Foxy’s where they are well known for live music and barbeques on the weekends. With this in mind, it makes for a great stop for the whole family. In fact, you can pick up your overnight mooring, then jump in the dinghy and head around the point into White Bay. Enjoy a ‘Painkiller’ at the Soggy Dollar Bar or a Delirious Donkey at Hendo’s Hideout before heading back around to Great Harbor for dinner.

Last but not least, you’ll have a long upwind sail ahead, so leave early (ish). You will be sailing around the West End of Tortola and up the channel to BVI Yacht Charters at Ritter Marina, Road Town by noon. Remember to give us a call before you arrive in order to check your docking details. Subsequently, we’ll have a taxi waiting once we have refueled you at our fuel dock and checked the boat back in with our team.

Boaty Ball Mooring

BoatyBall Mooring is an App that allows you to reserve and pay for mooring balls located in prime locations throughout the British Virgin Islands. The beauty of the App means that you can relax and enjoy your current location or take your time sailing to your next destination safe in the knowledge that your overnight mooring is reserved for your yacht.

The App places mooring balls into two categories: Reservable and First Come First Served (FCFS). To use the App, look for mooring balls that have the BoatyBall Logo on them.

Reservations Only Moorings.

The mooring balls are bright orange, a different shape, have numbers on them, and will have the BoatyBall logo clearly visible. Daily reservations for these moorings can be made from 7.00 am every morning. You can arrive at the mooring between 12 noon and 5.00 pm that same day and you must leave by 12 noon the following day.

BoatyBall.com also has mooring balls that are in a “first come first served” program.

Understanding The Moorings Charter Rates : The Moorings uses dynamic pricing for bareboat charters. This means that while the pricing is based somewhat according to seasons, the price may vary from week to week based on each week’s historical demand and the current availability. The Moorings prices are updated weekly and you lock in your rate when you pay your deposit. Checking Rates : Locate on the below table the BVI sailing catamaran, power catamaran or sailing monohull you’re interested in chartering. Click on Check Rates for the “Line” (aka years in service) that you want a price for. You’ll be redirected to the yacht’s information page where you can input a start date and an end date to see the exact base rate pricing. PLEASE READ THESE TERMS AND CONDITIONS (“ Terms ”) CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS AS WELL AS A SECTION GOVERNING THE JURISDICTION AND VENUE OF DISPUTES. THESE TERMS ALSO CONTAIN A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. By creating a username, a login, clicking submit, using the services of Charter Experts, LLC d/b/a Virgin Island Sailing® (“ Broker ) or by accessing Broker’s website, you agree that you have read, and acknowledge your acceptance of these Terms. The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

  • Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

  • Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
  • Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

  • Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
  • Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
  • Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

  • Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

  • No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

  • Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

  • Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
  • Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.
