RYA Bill of ale .... and ... Agreement for the sale and purchase of a boat

I am confused ... I am re-registering the boat on Part 1, and I have 1 the RYA Bill of Sale and 2 the RYA Agreement for Sale 3 the Registrar's form MSF To keep it Monday Morning simple, which forms do I need to fill in please ? It's a sale to joint ownership (me and daughter) not co-ownership, as recommended by experienced forum members previously. Also,looking through the boat's previous documentation, the price paid at one stage appears to have been £1. Is this some historical legal function and if so is it still valid ? TIA

Hi, If you're going for Part 1 registry, you will most likely need to use the latest MCA bill of sale which was revised in November 2018, After the end of February this year, the ships register is not accepting any old style bill of sale. The current BoS form is available at this link: https://assets.publishing.service.g...ile/763143/MSF_4705_Rev_1118_Bill_of_Sale.pdf The new form is now 4 pages, but unless you have multiple joint owners (more than you can fit on the first page) you will not need pages 3 & 4. It is best to print page 1 & 2 double sided. If you download the BoS form to your computer, you should then be able to open the BoS Pdf, then on the right hand side you should see 'Fill & Sign', click on this and then you can click on the fields on the form and type in the correct details. It is quite usual to use the words: One Pound and Other Considerations Also, in the shares box, the words are: 64/64 share, All Sixty Four Shares If there are two vendors, there should be two different witnesses, unrelated to the vendors I hope this helps, feel free to PM me if you have any questions.

I'm not new to boating but the guys who want to buy my boat are, so I hope I'm posting this under the correct topic.

When I purchased my boat the bill of sale from the brokers was 1 1/2 pages long; a friend of mine who sold her boat in 2017 used a one-page doc. 

My boat's buyers sent me a ten page (yes, 10) template which they downloaded from the RYA website which to me seems excessive, by being unduly minutious and I think not reasonable for this section of the boat market.

I'm attaching the one bill sale from my friend here (photo) and the ten page template I was sent by my boats buyers (word format).

Anyone care to opine and even posting redacted templates of the bills of sale you have used? bill of sale redacted.docx

That says all it needs to say,  There is not enough space in that to put a proper address.

It is also normal the have the signatures witnessed by an independant person, so no one can say "that's not my signature"

The witness should also show their adddress and signature.

This is the Governments legally enforcable bill of sale document for a boat.

Thanks both. So where do you think this 10 page thing applies for? It's like not even similar to either one of your examples.

By the way, my boat is not a yatch but a canal widebeam.

I may have used unclear language on my original post.

It's probably a contract for a sale agreement which is signed when a sale is agreed.   The bill of sale is signed on completion.

The document previously shown is simply your 'receipt for payment and transfer of ownership'

The 10 page document you refer to is (probably) the BMF/ RYA "Sales Contract"  (agreement to buy), and the terms and conditions which aply to the purchase / sale and agreed by both parties.

It lists who is responsible for insuring it, changes to the price following a survey, return of deposit, 'sea-trials' when it must be paid for etc etc and applies to all boats from a dinghy to a super-yacht.

You suggest it is not suitable for this 'section of the market', but without it your boat / £100,000 could be at risk.

eg. (extreme case)

You sell the boat without an agreement, a week later the buyer tries to take you to court for selling an unsafe boat that has killed his girfriend because of a leaky exhaust emitting Co into the cabin.

Alternatively, he has signed the T&Cs agreeing that he has had the opportunity to inspect the boat (or employ a qualified surveyor) which absolves you off responsibility once the boat has changed hands.

Your choice of course.

You're quite right it is the same document. I've included in my post but not sure others can see it.  At the end of my test there should be a link to download a word doc named ''bill of sale redacted"

I see it now but as it is titled 'Bill of Sale Redacted ' and then you included a 'screen shot' of a Redacted Bill of Sale I thought it was the same thing.

Never make assumptions !!

The 'link' you posted is not the 'Bill Of Sale', it is the contract Terms & Conditions.

Yes I got that from your previous replies. Not so much an ownership transfer but a contract to make sure I will actually bring the boat to the surveyor and what would follow, most of which are obvious and should not be mentioned, like the one that states the buyer can either not buy the boat or negotiate a discount depending on what the surveyor finds.

That is not obvious - in fact some brokers T&Cs specifically state that the deposit is non-returnable if you decide not to buy the boat if the surveyor finds something you 'don't like'.

Things may be obvious or common sense, but that is unfortunately rarely suffcient when large transaction are involved.

You can easily end up with "he said, you said" or "you never told me that" if it is not written down.

There's something else I had no idea about. I always assumed a deposit would never be refundable. I could not be bother with demanding a deposit so didn't even look into it. If the buyer is taking the expense of paying for a survey, he's definitely serious about buying the thing...

From holidays to yacht racing, The Royal Family has a long history of seafaring.

As we celebrate the Coronation of our new Monarch, His Majesty King Charles III, we look back at the RYA’s connections with The Royal Family and their passion for spending time on the water.

Her Majesty Queen Elizabeth II and Prince Philip, Duke of Edinburgh

Over the centuries the Monarchy has sailed aboard 83 royal yachts, including the most recent, HMY Britannia, which often hosted the RYA Council meetings during Cowes Week. 

In addition to her diplomatic duties on Royal Tours, HMY Britannia was also a vessel for family holidays. During the summer months, The Royal Family would often take off on what became known as the aptly named Western Isles tour, cruising around Scotland.

In 1948, Her Royal Highness Princess Elizabeth, Duchess of Edinburgh and Prince Philip, Duke of Edinburgh were listed as new members of the RYA (known then as the Yacht Racing Association). 

It became the Royal Yachting Association in 1952 when Sir Ralph Gore, then President, spoke of “Her Majesty’s recent command that the name of the Association will in future be the Royal Yachting Association."

The Duke of Edinburgh sailed frequently with Prince Charles in the Dragon Class keelboat Bluebottle, a wedding present to Her Majesty The Queen and The Duke of Edinburgh from the Island Sailing Club in Cowes, Isle of Wight. Bluebottle is the only British Dragon to have won an Olympic medal, picking up a bronze at the 1956 Melbourne Olympic Games.

Her Majesty Queen Elizabeth II was our Patron for many years and the Duke was elected as President of the RYA for the first time in 1956. It was under his watch, the first ever RYA Training Committee was formed.

A keen watersports fan, His Majesty King Charles III has been known to enjoy scuba diving and sailing – and was one of the first Royal members in the world to discover windsurfing in the 1970s.

Among many boating-related engagements over the years as The Prince of Wales, he visited the Olympic and Paralympic sailing venue at Weymouth and Portland National Sailing Academy (WPNSA) in the build up to the 2012 Games, christening the boat of 49er due Stevie Morrison and Ben Rhodes.

The Princess Royal

Following in her father's footsteps, Her Royal Highness The Princess Royal has been President of the RYA since 1987 and is also Patron of the RYA Foundation .

A keen sailor, Princess Anne and her husband, Vice Admiral Sir Tim Laurence, have kept a Rustler 44, Ballochbuie, at Ardfern in Scotland and have enjoyed cruising, sometimes as far as the Hebrides.

Amongst her duties as President, The Princess Royal has chaired almost every RYA AGM. She regularly visits sailing clubs across the UK to mark milestones, shows her support for the British Sailing Team and presents the annual RYA Volunteer Awards .

In an interview for RYA Magazine , she speaks fondly of her long history and love for sailing: “For me it’s important to have time away and sailing really is time away. It gives you a complete change from anything you’re doing and from my perspective, having a boat on the west coast of Scotland gives me two things – time away and in an attractive area.”

The Prince of Wales and Princess of Wales

The Prince and Princess of Wales also share a love for being outdoors and spending time on the water. The Princess of Wales has incorporated her love for sailing into her royal duties as Patron of sailing charity, the  1851 Trust .

When she was appointed, she said: “I feel very fortunate to have enjoyed sailing from a young age and I know it is a great way of providing young people with the opportunity to develop skills and confidence”.

As a family, the Prince and Princess of Wales enjoy spending time on the coast, introducing their own three children to sailing.

Co-ownership is where two or more people each own a proportion ( share) of the boat . This distinction may be significant, for example, if one owner were to die.
