The coast of Belize and its extensive outer reef comprise one of the world's most unspoilt natural environments. English is more widely spoken than most places in Central America (in fact it's the official language), so there's no communication barrier to having fun. Belize is famous for the barrier reef system it shares with the Yucatan Peninsula, with the Belize section stretching an unbroken 190 miles. The waters on the reef's western side sit over a limestone shelf that results in a relatively shallow expanse: ideal for snorkelling and diving, but with plenty of depths for extensive sailboat cruising.

There are charter boat bases nearby Belize City, the international point of entry, and at Placencia, a 40 minute flight south. The distance between bases makes a seven-day sailing itinerary a choice between visiting northern or southern sections of the string of cayes that line the barrier reef.  

Sailing Conditions in Belize

Prevailing winds in Belize waters clock primarily from northeast to southeast at a consistent 10-20 knots, making for glorious sailing conditions in smooth seas protected by the reef from the open Caribbean. The climate is sub-tropical and the annual temperature averages around 80° F (20º C).

A day's (or less) sail east of the Barrier Reef, the atolls of Turneffe, Lighthouse and Glover are amazing places to visit. The famous Great BlueHole is in this area. To venture outside the reef requires a hired skipper on board, as these waters are not well charted and there are numerous potential hazards. Things to do during yacht charter in Belize

  • Explore the Mayan ruins of Altun Ha. This could be one of the first things to do when you get ashore. Take a walk around ancient stone structures built by the Mayans dated back to 800-900 BC. Altun Ha is located just 30 miles north from Belize City.
  • Set up sails to Ambergris Caye. This caye is the largest island in Belize, and remains unspoiled despite being very popular among sailors. You can do some fishing in the morning and  then prepare your catch of the day for dinner.

Regulations for bareboat charters

  • Night sailing is forbidden in Belize.
  • A certificate of competency is mandatory for bareboat charter in Belize. If you renting a boat in Belize, you need to apply for this document to Belize Port Authority. The application is simple but should be made 2 weeks prior to your arrival. We will assist you and submit it for you locally.
  • Fishing is forbidden in marine reserves. 
  • Please also note that marine reserves typically charge fees per person of for the moorings.

Sailing in Belize

Main yacht charter base is located in Placencia, perfect start for you sailing vacation offering sandy low-lying cays where you can immerse yourself in beautiful, untouched and peaceful surroundings.

While ashore, you may discover Mayan ruins and meet locals who speak English and a dialect called Belizean Creole. The nation’s multi-cultural influences are everywhere, including the Mexican / Jamaican fusion cuisine and Afro-Caribbean music.

During your yacht charter in Belize you may visit three atolls: Glover’s Reef, Lighthouse Reef and Turneffe. There reefs will surprise you with rich marine life. Take a swim among 500 species of fish, 100 types of coral, sharks, rays, and dolphins.

The best time to rent a boat in Belize is during the dry season, from late November to mid-April. Warm temperatures, sunny skies and access to top attractions can be experienced this time of year. The temperature remain fairly consistent all year-round with an average range from 74°F to 84°F.

Belize yacht charter vacation offers balmy easterly trade winds year-round with the wind speed between 15 and 22 knots ideal for cruising conditions. Also you may enjoy calm waters while sailing inside the barrier reef.

Most passages are short and primarily line-of-sight, but plotting courses and referencing to the charts is must, due to the many reefs. Avoid Tom Owens Island as there are too many difficult underwater reefs. Also note that you’ll need local guide or skipper if you plan to sail outside of the barrier reef to Glover’s, Turneffe or Lighthouse Reefs.

Belize trade winds blow along the coastal cays consistently most of the year. Although cold fronts affect the country from October through to April the most likely months for frontal passages are December, January and February. In December and January fronts are most likely to become stationary over Belize.

Belize’s average temperatures all-year round range between 75F (24C) and 81F (27C). The coolest months traditionally start in November and end in January, while the warmest months are between May and September. The region’s humidity remains fairly consistent throughout the year at around 85 percent.

The easterly trade winds blow at 15 to 22 knots throughout the reef, which is just enough for charterers to enjoy a fantastic sailing experience. To get away from the wave action of the open Caribbean, though, all you need to do as a sailor is move to the west of the reef.

For some people, the perfect time to charter a bareboat in Belize is between March and April after the winter northerlies have passed, but for others, August and September are exceptional, especially when tropical storms aren’t there.

You can sail the reef, though, at any time of the year on bareboat charter, provided you have basic coastal and navigation skills and are okay with the weather. But having your bareboat skippered by an experienced local captain is something that can make your adventures smoother.

Bareboat Charter Requirements in Belize

For you to bareboating in Belize, it is a must that you have an ASA 103 certification or RYA Day Skipper qualification. Belize Port Authority requires the charterer to have a Temporary Certificate of Competency. To obtain the certificate, you’ll need to fill out the relevant application form and send it with a copy of your passport plus a picture of yourself to the Belizean Port Authorities.

For a bareboat charter, no captain, crew, or provisioning is provided. So it is upon you to organize for such things before embarking on your Belize sailing journey. Sailing in the Belizean waters, though, is as adventurous as it gets. Landmasses will appear lush and low from the deck, and there are lots of flat, palm-studded cays that can melt your heart as you cruise on.

Should You Hire a Skipper?

Belizean waters are very complex to navigate, and having local knowledge is critical because the chart data available is still based on old British surveys. It is not uncommon to have a few bare boaters getting lost somewhere on the reef every year. And that is not fun at all.

Sailing beyond the barrier reef or the area around the southernmost reaches is particularly challenging. So having an experienced local skipper on board can help you smoothly and safely go outside the barrier reef and explore the many atolls that feature unique Belizean marine life.

Sailing off the coast in and around the countless cays of the world’s 2nd largest barrier reef proffers great opportunities to explore and experience the best of Belize . There are numerous lagoons, wildlife sanctuaries, diving grounds, and untouched mangrove islands that you can find along the way as you hop from one island to the next.

Here are some of the places you should not miss visiting while on a sailing tour in Belize:

Placencia is a village in Stann Creek District, Belize, that’s known for its beautiful palm-lined beaches. While sailing in the region, you can indulge in many activities, including, but not limited to, hiking through mountainous rainforests, diving, kayaking, deep-sea fishing, and exploring the Mayan Ruins. If a little peace and quiet are what you need for your holiday, then you can find respite in the Placencia peninsula’s tranquil beaches that span about 16 miles across.

Tobacco Cay

Tobacco Cay, which sits about 10 miles east of Dangriga, is a tiny egg-shaped island with an east-west dimension of about 125 meters and a north-south dimension of 240 meters. In this cay, there are lots of fun activities to engage in, such as swimming, snorkeling, diving, kayaking, and fishing. Lazing on the hammock, reading a novel, and sharing group meals are also things that can fill up your day in this part of Belize.

Reef End’s Lodge

Located on the southern tip of Tobacco Cay, Reef End’s Lodge has a lot to offer in terms of food, accommodation, and underwater exploration. The waters surrounding the lodge are endowed with beautiful corals and spectacular marine creatures such as rays, nurse sharks, turtles, and more. So snorkeling, diving, and swimming are no doubt wonderful activities to try here. Such atolls as Glovers Reef, Lighthouse Reef, and Turneffe Flats are also within reach, something that gives you even more exploration options.

Blue Field Range

Blue Field Range is a small charming island located near Harmony Head and Rendezvous Cay. The range is tranquil, with mangroves around, and has crystal clear waters that are perfect for snorkeling, kayaking, and swimming. You’ll also get a unique chance to play with manatees, which can be great fun, especially if you’ve never met one before.

Rendezvous Cay

Sitting on the edge of Belize’s barrier reef, the 1400-square-foot Rendezvous Cay is home to one of Belize’s most pristine reef formations and magnificent marine life. The cay has crystal–clear waters, amazing snorkeling & diving sites, perfect-sugar sandy beaches, and a couple of coconut palm trees. Spending a day here snorkeling, diving, swimming, or sunbathing is something that can surely never disappoint.

Sergeant’s Cay has a barrier reef that offers one of the most fun snorkeling opportunities in the Caribbean. You can go snorkeling solo or join in the guided snorkel tours. While underwater here, you’ll encounter an extensive variety of colorful corals, sea fans, sea urchins, and amazing schools of tropical fish.

Hol Chan Marine Reserve

Hol Chan Marine Reserve sits close to Caye Caulker and Ambergris Caye, just off the coast of Belize. The marine reserve covers about 18 square kilometers of mangrove forest, coral reefs, and seagrass beds. Snorkeling here not only allows you to witness spectacular spur and groove formations but also gives you an opportunity to encounter firsthand large schools of snappers, jacks, groupers, barracuda, eagle rays, parrotfish, hogfish, and other pelagic creatures.

Sailing Level Required  in Belize 

If you, as a bareboat charterer, have an ICC RYA (Level 3), then you can sail behind Belize’s cays and reef. That way, you’ll be able to navigate through short passages and the side of the reef where waves are minimal.

Remember to keep a vigilant bow watch when sailing the shallow depths and reefs, and having solid anchoring skills is a must here. As stated earlier, going beyond the reef requires you to bring a local skipper who very well understands the waters and how to navigate through them.

Getting There

If you are traveling from any of the major cities in the US like New York, Los Angeles, Chicago, and Denver, you can take a 4 to 5-hour direct flight to the small but welcoming airport in Belize. From Miami, Florida and Houston Texas though, it takes a mere 2 hours 15 minutes or so to connect to Belize.

There are also direct flights from Toronto, Canada coming to this side of the Caribbean. From Mexico, you can take a direct flight to Belize from Cancun and Chetumal. Other Central American countries like Honduras, Guatemala, and Costa Rica also offer direct flights to Belize.

From the airport in Belize City, it will take a few minutes’ drives may be 20 minutes or so- to get to your bareboat charter yacht.

Belize already looks like a great place to visit. The scenery is certainly appealing and I wouldn’t mind spending my holiday here.

I do have some questions, what is the average cost of chartering a boat to sail on? And must I be a sailor to charter a boat, can’t I have someone else sail the boat on my behalf?

Price varies according to the type of boat, the duration, the size, etc. For a bareboat in Belize, the price could start around $3800 and can rise depending on your requirement.

You don’t need to know how to sail if you have a skipper on board. The price of a skipper on an average is between 90 to 150 euro per day. It really helps when you have skipper that navigates the boat:)

Wow, Belize looks wonderful! My oldest son and his wife are looking at going on a yacht trip for their “second” honeymoon. Prices vary and depend on the type of yacht, duration etc. But on average for a bareboat in Belize, it is around $3500 per week. And if you split the price with some friends, then it will reduce the cost significantly.

“Plenty of cayes for exploring,” says Pacôme Touzé, manager of the Belize Dream Yacht Charter base, an operation housed in a rustic hardwood cabin in the southern reaches of this Central American country. He points at the chart, describing anchorages with his delightful French accent. “Four hundred fifty cayes.”

I ask him about marinas or mooring balls. He shrugs his shoulders insouciantly.

“You will mostly be anchoring – anchorages you’ll share with with no one. Cayes: oui. Marinas: non.”

After the bareboat charter briefing my friend (and crew member) Ed North and I stroll back to “Cavok”, our chartered Lagoon 421. “Solitude,” says Ed, sighing contentedly.

“Far from the madding crowd,” I say.  

It is, in retrospect, an overwhelming understatement.

A FABULOUS FLOAT PLAN

The Dream Yacht Charter briefing is a metaphor for the Belize sailing experience. Three people present: Pacôme, Ed and me.  

Pacôme showers us with information. Ed looks on, smitten. I take notes furiously.

“Nice snorkeling around Lagoon Caye,” says Pacôme. “Very pretty – and secluded mangrove lagoon inside. Might see some manatees.”

Lagoon Caye is the first waypoint in a fabulous float plan. But for a cabin cruiser tucked inside because its draft is minimal and a couple of bone-fisherman who stop to say ‘hi’ mid-afternoon, we own the place.

Think perfect sunsets with distant blue mountains for a backdrop. Cold Belikin beers for Ed and I. Chilled wine over dinner for my wife Sharon and Kim, Ed’s wife.

Pacôme has armed us with a cornucopia of appealing waypoints and passages, though we end up modifying our float plan with the best of intentions.

‘Fun made good’ beats out ‘velocity made good.’

UNSURVEYED AREA (USE CAUTION)

First day out, en route to Lagoon Caye, our sails are taut in fifteen knots of wind.  

An hour in, Ed indicates the chartplotter. “’Unsurveyed area. (Use caution).’ ‘Numerous coral heads. (Dangerous’).”

Sailing conditions for a Belize charter aren’t particularly challenging, partly because the barrier reef system – one-hundred-eighty-five miles long – mostly protects you from big seas. But that system comes with its own hazards. A constant lookout underway is crucial.  

Then again, sometimes those reefs bring unexpected delights.

One day we hug the reef north from Southwater Caye before dropping the hook to dinghy over for a snorkel.  

Four feet of water. Conch, a curious lobster, amazing coral and fish.

Two days later at Pelican Cayes we snorkel mere yards from an uninhabited beach.

Fan coral, elkhorn, brain coral. Gardens of coral. Forests of coral.

That night over dinner Kim waxes enthusiastic.

“Needlefish, butterfly fish, parrotfish, a manta ray, scores of sergeant-major fish.”

Dinner itself is an equal delight. The Hideaway, run by Kim and Dustin Ingersoll, must be one of the world’s most secluded restaurants.

Rum punches served on handmade wooden tables. Conch and shrimp and snapper Dustin caught today. Dining in an open-air hardwood building beneath a thatched roof.

Plan A next morning was to be an early start, making for a more distant caye Touzé had recommended back at the Dream Yacht Charter briefing.  

We opt instead for a less ambitious waypoint. We’re staying here for just one more snorkel.

After that we will make for a town named ‘Pleasant.’  

A TOWN NAMED ‘PLEASANT’

Given our desire for ‘course made good’ at the start of our charter, we’d given short shrift to this resort town near the Dream Yacht Charter base.

Now, on our last full day, we decide to rectify that. Tonight we’ll overnight off Placencia.  

‘Placencia’ basically means ‘pleasant place.’ How could we resist?

We arrive, after a great day of sailing, late in the afternoon.

Next morning we dinghy in and explore one walkway that runs beside a pristine beach for roughly a mile, populated by several restaurants, dive shops, an art gallery, turquoise-painted Barefoot Beach Bar.

We have to meet Pacôme late that day to refuel and debrief back at the Dream Yacht Charter base around the corner so we while away several delightful hours at the Barefoot.

Think sun, sea, sand and some Mango Piña Coladas.

When we dropped anchor yesterday a dolphin broke the surface, splashing around “Cavok” before disappearing.  

It was a perfect introduction to a town named Pleasant.  

FAR FROM THE MADDING CROWD

Back on the docks on our last evening in Belize we dine aboard, clearing out provisions, downing the last remaining Belikin beers, replaying trip highlights in the cockpit of “Cavok”.

“The dolphins off Maho, that one that came up when we anchored off Placencia,” says Kim.

“Those pelicans skimming the water at Lagoon,” says Sharon.

“The snorkeling. All these cayes,” says Ed.

“The run to Coco Plum,” I add. “Full day under sail and we see five boats.”

Three dolphins. Thirty pelicans. Four hundred fifty cayes. Five boats.

We’ve been bareboating Belize. Far from the madding crowd.

Can you rent a bareboat yacht in Belize – do I need a license?

In Belize, a license is not specifically required. You simply need to fill out a sailing resume and only charter a yacht that your experience permits. Before you confirm your sailing trip to the Belize, please send us your sailing experience, or a copy of your skipper licence and we will check it for you. If you do not have a skipper license, or experience it is also possible to rent a bareboat yacht with a skipper

There are sailing opportunities from several spots in Belize, including Belize City and Placencia. The barrier reef can assist with calm seas, but be aware that much of the sailing is quite shallow and may require extensive bow watch. Sailing up and down the barrier reef and associated island is a beautiful place to be. The reef offers excellent scuba diving and snorkeling. Some islands have small resorts, with bars and restaurants open to the public. One of my favorite spots was  Hideaway Caye .  Hideaway is a small island owned by a family of three.  Tie up to one of their mooring balls, radio in to make your dinner arrangements, and have a fantastic meal in an open air treehouse with Dad as the Bartender, Mom as the cook, and their daughter helping out.   We also enjoyed South Water Cay, and Tobacco Caye.

PLEASE READ THESE TERMS AND CONDITIONS (“ Terms ”) CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS AS WELL AS A SECTION GOVERNING THE JURISDICTION AND VENUE OF DISPUTES. THESE TERMS ALSO CONTAIN A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. By creating a username, a login, clicking submit, using the services of Charter Experts, LLC d/b/a Virgin Island Sailing® (“ Broker ) or by accessing Broker’s website, you agree that you have read, and acknowledge your acceptance of these Terms. The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

  • Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

  • Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
  • Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

  • Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
  • Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
  • Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

  • Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

  • No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

  • Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

  • Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
  • Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.
