Two children dead, multiple injured after car slams into Michigan boat club hosting kids' birthday party
T wo children were killed and over a dozen people were injured after a driver crashed into a Michigan boat club where a birthday party was taking place, authorities say.
The incident took place at Swan Boat Club in the Charter Township of Berlin at around 3 p.m. on Saturday afternoon. Two siblings, a 5-year-old boy and an 8-year-old girl, were killed.
At least 15 people were wounded in total. Six adults and three children had life-threatening injuries and were being treated as of Saturday night.
A Michigan State Police spokesman told Fox News Digital that the driver of the vehicle, a 66-year-old woman, was intoxicated at the time. The car plunged 25 feet into the building.

Monroe County Sheriff Troy Goodnough choked up multiple times at Saturday night's press conference as he described the gruesome scene.

"The scene was just described by the first responders as is extremely chaotic, with high level of emotions of those directly involved and those who witnessed this horrific incident," he said.
In a statement to Fox News Digital, Goodnough called the situation "tragic" and confirmed that a child's birthday party was being held at the boat club at the time.
"Preliminary investigation reveals that a vehicle drove through a building where a childrenâs [sic] birthday celebration was taking place, seriously injuring a number of people, both children and adults," the statement read. "The victims have been transported to several area hospitals."
In a Facebook post. Swan Boat Club announced that it was temporarily shuttering because of the incident.

"In light of the emergency please do not try to come to Swan Boat Club at the moment so emergency vehicles can get through," the boat club said in a post. "At this time the club is closed until further notice."
"Please keep everyone involved in your thoughts and prayers. We thank everyone for their concern and prayers," the business added.
Authorities are actively investigating the incident and are bringing criminal charges against the suspect, who is being held at Monroe County Jail. No additional details are known at this time.

Michigan woman charged in boat club crash that killed 2 children released on bond
A Michigan woman facing eight charges stemming from a crash that killed two children at a boat club was released Thursday on a $1.5 million bond, according to the jail and her attorney.
Marshella Chidester, 66, is accused of slamming an SUV into the Swan Boat Club, where a birthday party was taking place on Saturday about 30 minutes southwest of Detroit. Two children died and over a dozen others were injured, with several still hospitalized.
The Newport, Michigan, woman was released two days after she was arraigned in Monroe County District Court on the charges, which include two counts of second-degree murder and two counts of driving while intoxicated, causing death.
Two siblings, 8-year-old Alanah Phillips and 4-year-old Zayn Phillips, were killed. Their mother, Mariah Dodds and her 11-year-old son survived, though he's facing serious injuries including broken legs and ribs and a fractured skull.
Chidester suffers from 'epileptic type seizures,' attourney says
Bill Colovos, Chidester's attorney, argued in court that his client suffers from "epileptic-type seizures" in her legs and that she only had one glass of wine the day of the crash.
Upon Chidester's release Thursday, Colovos emphasized that a medical issue caused the crash, adding that his client suffers from neuropathy, "blacked out" from a seizure and is "very remorseful."
"She feels absolutely horrible. To black out, then all of the sudden be told that two young children were killed. Colovos told the Detroit Free Press , part of the USA TODAY Network. "It's like a bad dream you wake up from."
Chidester started having the seizures in November and a doctor told her to stop driving for two months, but did not restrict her further, Colovos said in court earlier this week.
Alcohol breath test exceeded legal limit, prosecutor says
Monroe County prosecutor Jeffery Yorkey said in court that a preliminary alcohol breath test was "significantly over the legal limit" but did not specify what the results were. Colovos said he is still waiting on a medical report that would determine his client's blood-alcohol level around the time of the crash.
"Believe me, I'm waiting for it," Colovos said.
Yorkey asked for the $1.5 million cash bond, pointing to what he says is a history of "severe substance abuse."
Judge Christian Horkey agreed to the bond and set conditions upon her release: Chidester is prohibited from consuming alcohol or any illegal substances and is not allowed to drive. She must undergo substance abuse testing and monitoring, which includes wearing a tether, Horkey said.
Mother sues nearby restaurant Chidester visited
Dodds filed a lawsuit against Chidester and the restaurant that police say Chidester was drinking at earlier in the day of the crash. The business temporarily closed after the crash due to the police investigation.
The lawsuit accuses Chidester of gross negligence, alleging she drove into the north wall of the boat club fast enough to enter about 25 feet inside the building until her car stopped.Â
The lawsuit also accuses the restaurant of selling Chidester alcohol while she was visibly intoxicated.
Angie Huffman, who said her mother owns the restaurant, confirmed in an email to the Free Press that Chidester visited the restaurant at 11 a.m., saying she had one glass of wine and a bowl of soup. Huffman said she's confident the police investigation will show the restaurant is "not at fault."
Family receives over $224,000 in donations
A GoFundMe for the family was linked at the club's website and raised over $224,000 as of Thursday. The funds will go toward funeral and burial costs, as well as future medical and other incurred expenses as the family mourns.
In an update Tuesday, the page said funeral service arrangements are on hold until the parents "are in a more stable condition for such decisions and planning."

Sheriff identifies young siblings killed by driver who crashed into party
Officials in southeastern Michigan have identified the 8-year-old girl and her 4-year-old brother who were killed Saturday when a suspected drunk driver plowed through a childâs birthday party at a creekside boat club.
Monroe County Sheriff Troy Goodnough in a statement Monday identified the children as Alanah Phillips, age 8, and Zayn Phillips, age 4. Diane Harrington, the victimsâ aunt, said in a verified fundraiser for family funeral costs that the childrenâs mother and older brother remained hospitalized. Harrington declined to comment when reached by phone Sunday.
Monroe County Prosecuting Attorney Jeffrey A. Yorkey is expected to announced a final charging decision Tuesday against the 66-year-old driver. The woman, who has not been identified but was cooperating with police, was arrested at the scene Saturday after she slammed her SUV into the side of the Swan Boat Club about 3 p.m. and continued about 25 feet into the building before coming to a stop. The woman was taken into custody for operating a motor vehicle while intoxicated and causing death.
Among the nine people hospitalized, an 11-year-old boy and a 31-year-old woman remained in critical condition Monday, three teenagers were listed in serious condition, and five other people were treated for minor injuries, Goodnoughâs office said.
âThe scene was described by the first responders as âextremely chaotic,â with [a] high level of emotions of those directly involved and those who witnessed the horrific incident,â Goodnough said during a Saturday news conference.
Gasps rippled through the room when Goodnough, in a trembling voice, said the two young party attendees pronounced dead at the scene were siblings.
Six adults and three children were rushed to the hospital by ambulance and helicopter with serious injuries after the crash at the boat club in Berlin Township, roughly 30 miles south of Detroit.
Video of the crash captured by doorbell camera shows a black SUV speeding through the boat clubâs parking lot before crashing out of the frame and sending plumes of smoke and dust into the air.
Authorities said they were investigating a local tavern several miles away, where the suspect was believed to have been served before the fatal crash.
âWe went in, we shut the business down, and we executed a search warrant into the business conducted that day,â Goodnough said.
The Swan Boat Club said in a Facebook post that it would remain closed Sunday and asked the community for prayers and support for the victimsâ families.

Driver, restaurant sued by mother of birthday party victims killed in boat club crash
The mother who lost two children Saturday when a car plowed into a private Monroe County boat club has sued the accused driver and a local tavern she allegedly visited the day of the crash.
The lawsuit, filed Monday in 38th Circuit Court in Monroe County, alleges the woman, now identified by authorities as 66-year-old Marshella Chidester, acted with gross negligence when she crashed into the Swan Boat Club on Saturday afternoon during a children's birthday party.
The crash killed two of Mariah Dodds' children and injured her third, identified as J.P. The Monroe County Sheriff's Office identified the two children killed as siblings Alanah Phillips, 8, and Zayn Phillips, 4. The crash injured more than a dozen other people.
Chidester was arraigned Tuesday on two counts of second-degree murder, two counts of operating under the influence of alcohol causing death and four counts of operating under the influence of alcohol causing serious injury. She has been held at Monroe County's jail.
"Defendants destroyed plaintiffs' family relationship. Mariah Dodd(s) lost her two children," according to the lawsuit.
Dodds' lawsuit also alleges Verna's Tavern is responsible for Chidester's actions because they continued serving her alcohol even after she was visibly drunk.
The lawsuit seeks to hold the restaurant accountable for allegedly violating Michigan's "dram shop" law, a type of statute that allows an injured person to bring a claim against a business for serving alcohol to an underage person or someone who is visibly intoxicated.
"Generations of experience of sales of alcohol have told us that irresponsible sale and use causes people to get hurt," said Jon Marko, an attorney for Dodds.
He added someone who has been harmed can also bring a claim against the individual person who served the alcohol, but that approach is rare.
"The business is responsible for its employees," Marko said.
Authorities closed the bar, which was less than 5 miles from the boat club, after Saturday's crash and executed a search warrant to learn more about the dayâs business, Monroe County Sheriff Troy Goodnough said Saturday night.
Bill Colovos, Chidester's attorney, said Tuesday that the search warrant of Verna's found that Chidester only had one glass of wine and a bowl of chili for lunch from 11 a.m. to noon Saturday. The crash occurred at three hours later at the boat club, which is 3.4 miles from the bar.Â
Colovos said at her arraignment that she has no criminal record and is retired. He said she received treatment the day of the crash for a recent history of seizures in her legs. He called the crash "absolutely horrible."
An employee who answered the phone at Verna's on Tuesday morning referred The Detroit News to an attorney for the restaurant who could not immediately be reached.
Drunk driver in Michigan birthday party crash that killed young siblings, 4 and 8, charged with murder
An intoxicated driver was charged with murder after crashing into a Michigan business where a child's birthday party was being held and killing two young siblings, authorities announced Tuesday.
Marshella Chidester, 66, hit a building at Swan Boat Club in Berlin Charter Township around 3 p.m. on Saturday. It came to a stop 25 feet inside where the party was taking place, Monroe County Sheriff Troy Goodnough told reporters Saturday.
In an arraignment hearing Tuesday, Chidester was charged with two counts of second-degree murder, two counts of operating under the influence of alcohol causing death and four counts of operating under the influence of alcohol causing serious injury. Her bond was set at $1.5 million. If convicted, Chidester could be sentenced to up to life in prison.
Zayn Phillips, 4, and his sister, Alanah Phillips, 8, were declared dead at the scene, Goodnough said in an update Monday. The sheriff's office previously reported that Zayn was 5-years-old.
A third sibling survived with âsevere injuries," according to Andrew Brodie, the superintendent of Flat Rock Community Schools, an area public school district.
At the arraignment, Bill Colovos, an attorney for Chidester, said she has a history of epileptic seizures in her legs and lost control of the car when she crashed. He also said that his client only had one glass of wine four hours before the crash, according to a search warrant executed at the bar where she allegedly was.
"This is not a monster," Colovos said about his client, adding that she doesn't have a criminal history. "Itâs horrible what happened, absolutely horrible. I have two children. It's absolutely horrible. But some things we donât have control over."
Chidester was seen in court with a cast on her right arm, wearing a striped white and black prison uniform.
Monroe County Prosecuting Attorney Jeffery A. Yorkey refuted the claim that Chidester had a seizure during the crash and said that "her blood alcohol level was significantly over the legal limit." He didn't mention what her blood alcohol level was.
"There is no indication, whatsoever, in any of the evidence that we have uncovered in this case, that the defendant suffered from a seizure at the time of this incident," Yorkey said during the hearing.
"She indicated herself that she had some seizure issues and she was on some medication, and that she wasn't supposed to be drinking, but admitted that she had been drinking that day," Yorkey said.
A woman who identified herself as the grandmother of Zayn and Alanah spoke at the arraignment, accusing Chidester of drinking and driving.
"She chose to drink and drive and she took my grandbabies from us," the woman said.
A woman who identified herself as the aunt of the two children said she was at the scene of the crash, and saw her niece and nephew in their final moments.
"They walked into that birthday party having a fun time," she said. "They were sitting at that table, eating, and this woman crashed her car through this building, destroying all of our lives. Not just my family, everyone else that was in that building."
She says her other nephew and her sister, the children's mother, were hurt in the crash and are still fighting for their lives.
"I had to be the one to tell my sister her babies were gone when they removed her ventilator yesterday," the woman said. "She said 'How am I supposed to live without my babies?'"
"No one should ever have to go to a birthday party thinking that theyâre gonna die," she said tearfully.
Zayn's birthday was coming up next month, according to Monroe County Undersheriff Joe Hammond.
"We were supposed to be planning a birthday party for Zayn, not a funeral," the child's aunt said.
Approximately 13 others were injured in the crash, Goodnough said on Saturday. Nine of those people, who range in age from 11 to 66-years-old, were hospitalized, according to the Monroe County Sheriffâs Office.
Five remain in critical condition, including an 11-year-old boy, a 14-year-old boy, a 16-year-old girl, an 18-year-old woman and a 31-year-old woman.
The four other victims, who range in age from 57 to 70, had minor injuries. A 42-year-old man also received treatment on his own for minor injuries.
Chidester's next court appearance is scheduled for April 30.

Woman charged with murder in crash that killed young brother and sister at birthday party
A Michigan woman has been arraigned on second-degree murder after prosecutors say she drunkenly crashed her SUV into a boat club that was hosting a birthday party, killing a boy and his sister.
Surveillance video from a Michigan home near where a suspected drunken driver slammed into a childâs weekend birthday party shows just how fast the driver was going before the crash happened. It also picks up the screaming and confusion afterward.

A Michigan woman was arraigned Tuesday on second-degree murder and other charges after prosecutors say she drunkenly crashed her SUV into a boat club that was hosting a childâs birthday party, killing a young brother and sister and injuring several other people.
Marshella Chidester, 66, did not enter a plea to the eight counts she faces in Saturdayâs tragic crash at the Swan Boat Club in Monroe County, about 30 miles (48 kilometers) south of Detroit.
During a court hearing that was livestreamed, Chidesterâs right arm was in a cast from just above the elbow to her fingers.
She has been jailed since the crash and the judge set her bond at the $1.5 million prosecutors requested after relatives of some of the victims asked him to set it at that level.
In arguing for the $1.5 million bond, prosecutor Jeff Yorkey told the court that Chidester has had substance abuse issues that were corroborated by her friends and family.
Defense attorney Bill Colovos asked the judge to set Chidesterâs bond at $100,000. He said she only had a glass of wine and a bowl of chili four hours before the crash, and that she has suffered since November with âepileptic-type seizures in her legs.â
âThis is not a monster, â Colovos said. âItâs horrible what happened, but there are some things we donât have control over.â
Colovos added that prior to Saturdayâs crash, Chidester had no traffic tickets or police record.
Yorkey responded that there was no indication that Chidester suffered a seizure before the crash and that testing showed her blood alcohol level was âsignificantly over the legal limit.â
If Chidester posts bond, she will be required to forfeit her passport, have no alcohol, wear a tether and not drive. A probable cause conference has been scheduled for April 30 followed by a May 6 preliminary examination.
Chidester is a former commodore at the boat club, The Detroit News reported.
The crash killed 8-year-old Alanah Phillips and her 4-year-old brother, Zayn Phillips, the sheriffâs office said. Their mother, Mariah Dodds, and another sibling were among the injured.
The party was for the 3-year-old child of Doddsâ friend, according to a Detroit law firm representing Doddsâ family in a lawsuit against Chidester and the tavern where she reportedly was before the crash.
Dodds suffered broken ribs, a collapsed lung, cuts and bruises, according to the law firm. Her surviving son suffered broken legs, broken ribs and a fractured skull.
Raquel Smouthers told the court that she was at the party and witnessed the deaths of her nephew and niece.
âThey were sitting at that table eating, and this woman crashed her car through this building destroying all of our lives,â a nearly inconsolable Smouthers said. âNobody should ever have to go to a birthday party thinking that theyâre gonna die.â
The boat club located off Swan Creek near Lake Erie is a membership-based organization that hosts holiday parties and other events, and provides docking space for members who own boats, according to its website. The club also advertises on social media that members can rent the clubhouse or pavilion for personal events including birthday parties.
