Democrats Seek Criminal Investigation of Justice Thomas Over Travel and Gifts

The senators said the Supreme Court justice’s failure to disclose lavish gifts and luxury travel showed a “willful pattern of disregard for ethics laws.”

Two top Democratic senators have asked the Justice Department to open a criminal investigation of Justice Clarence Thomas for possible violations of federal ethics and tax laws.

Senators Sheldon Whitehouse of Rhode Island and Ron Wyden of Oregon sent a letter to Attorney General Merrick B. Garland last week asking that he appoint a special counsel to investigate Justice Thomas’s failure to disclose lavish gifts , luxury travel , a loan for a recreational vehicle and other perks given to him by wealthy friends.

The request further intensified efforts by Senate Democrats to scrutinize Justice Thomas’s conduct at a time when they are trying to force Supreme Court justices to comply with stricter ethics and financial disclosure rules.

“We do not make this request lightly,” the senators wrote in a joint statement. “Supreme Court justices are properly expected to obey laws designed to prevent conflicts of interest and the appearance of impropriety and to comply with the federal tax code.”

“No government official should be above the law,” they added.

Specifically, the senators asked that a special counsel investigate whether Justice Thomas violated federal ethics and tax laws by failing to disclose as income the $267,000 he received in forgiven debt for a luxury R.V.

The senators wrote that Justice Thomas had “repeated opportunities” to explain his failure to disclose the gifts to the Senate Finance Committee, of which Mr. Wyden is the chairman, as well as the Judiciary Committee’s panel on federal courts, which Mr. Whitehouse leads.

They also accused Justice Thomas of showing a “willful pattern of disregard for ethics laws,” behavior that they said surpassed that of other government officials who have been investigated by the Justice Department for “similar violations.”

A spokeswoman for the Supreme Court did not immediately respond to a request for comment.

Clarence Thomas' Yacht Trip to Russia Raises Questions

A letter from two Senate Democrats alleging that U.S. Supreme Court Associate Justice Clarence Thomas failed to disclose a yacht trip to Russia has raised questions about the Court's longest-serving member.

Senators Sheldon Whitehouse and Ron Wyden sent the letter to Attorney General Merrick Garland on July 3 accusing Thomas of failing to disclose gifts from billionaire Republican donor Harlan Crow and asking Garland to appoint a special counsel to investigate the matter.

Whitehouse is chairman of the Judiciary Subcommittee on Federal Courts and Wyden serves as chairman of the Senate Finance Committee. The senators' list of "likely undisclosed gifts and income" from Crow and his affiliated companies to Thomas included a 2003 yacht trip to Russia and a private helicopter flight to a palace in St. Petersburg, the home town of Russian President Vladimir Putin .

The claims come as Democratic Representative Alexandria Ocasio-Cortez announced on Wednesday that she had introduced articles of impeachment against Thomas and fellow conservative Supreme Court Justice Samuel Alito .

In a move separate to the senators' letter, Ocasio-Cortez has accused Thomas and Alito of failing to disclose gifts and reimbursements and refusing to recuse themselves in cases in which they had conflicts of interest.

Thomas, the Court's most senior conservative, has been facing calls to resign for months—and efforts to impeach him—over his relationship with Crow and luxury trips he received from the billionaire GOP donor.

Newsweek has reached out to the Supreme Court via email for comment.

Commentators on social media site X, formerly Twitter , raised questions about Thomas' reported visit to Russia in posts on Wednesday.

"Clarence Thomas took secret unreported trips to Russia aboard a yacht and to one of Putin's palaces — in 2003," wrote lawyer and legal commentator Tristan Snell.

"That feels important somehow. Maybe — hear me out here — just maybe, we should launch a full and thorough investigation into Thomas and his Kremlin connection," Snell added.

Journalist and lawyer Seth Abramson wrote: "Clarence Thomas possibly meeting secretly with Kremlin officials in Russia and then committing felony Tax Fraud to cover it up is just another major breaking news story media has no time to cover because Biden cleared his throat a few extra times 12 days ago."

"America is screwed," Abramson added.

There was no suggestion in the senators' letter that Thomas met with any Russian officials during his visit to the country.

Olga Lautman, a senior fellow at the Center for European Policy Analysis (CEPA) highlighted a report from The Daily Beast on the senators' report.

"Hold on! WTH is a U.S. supreme court justice taking yacht trips and helicopter rides to Russia?" Lautman wrote on X .

"Before Kanye West went to Russia, Supreme Court Justice Clarence Thomas did it on Harlan Crow's dime and took a lovely helicopter ride to the palace in Putin's hometown," wrote Grant Stern, executive editor of political organization Occupy Democrats .

"YOU CAN'T MAKE THIS STUFF UP!" Stern said.

In their letter to Garland, Whitehouse and Wyden argued that the evidence against Thomas "warrants criminal investigation." They also accuse him of never paying taxes on a more than $267,000 loan forgiven by another wealthy business owner, Anthony Welters.

"Appointment of a Special Counsel would serve the public interest," the Democrats wrote. "The public must have confidence that the judiciary and the Department of Justice execute their responsibilities fairly, impartially, and without respect to political expedience or partisan interests."

Clarence Thomas Took Free Yacht Trip to Russia, Chopper Flight to Putin’s Hometown: Dems

The allegedly secret gifts were disclosed in a letter from two Democratic senators that accused Thomas of potentially committing tax fraud.

Supreme Court Justice Clarence Thomas has been accused of not disclosing a yacht trip to Russia and a private helicopter flight to a palace in President Vladimir Putin’s hometown, among a slew of other gifts and loans from businessman Harlan Crow .

Buried on page 14 of a letter that two Democratic senators sent to Attorney General Merrick Garland on Tuesday, in which they urged Garland to appoint a special counsel to probe Thomas, was an astonishing list of dozens of “likely undisclosed gifts and income” from Crow, Crow’s affiliated companies, and “other donors.”

In the letter, Sens. Sheldon Whitehouse (D-RI) and Ron Wyden (D-OR) said Thomas, one of the court’s staunchly conservative justices , even may have committed tax fraud and violated other federal laws by “secretly” accepting the gifts and income potentially worth millions.

“The Senate is not a prosecutorial body, and the Supreme Court has no fact-finding function of its own, making the executive role all the more important if there is ever to be any complete determination of the facts,” reads the letter requesting the appointment of a special prosecutor. 

“We do not make this request lightly,” said the letter. 

The list of potentially secret gifts also includes a loan of more than $267,000 provided by Thomas’ close friend Anthony Welters, the yacht trip to Russia from the Baltics, and the helicopter ride to Yusupov Palace in St. Petersburg. ProPublica first reported last year on the existence of extensive undisclosed gifts and lavish trips from Crow.

Additionally, Justice Thomas is accused of not disclosing tuitions for his grandnephew, free lodging, real estate transactions, and home renovations. The action escalates Democratic senators’ efforts to hold Thomas accountable for perceived ethics controversies. 

According to the senators, Thomas’ conduct could violate the Ethics in Government Act, which requires officials like Supreme Court justices to file annual reports disclosing gifts and income accepted from outside sources.

“It is a crime,” reads the report, “To knowingly and willfully fail to file or report such information.”

Since 2023, two Senate committees have been looking into the 1991 loan from Welters that was connected to Thomas’ purchase of a luxury motor home. Welters previously responded to a New York Times request for comment on the loan only to say that it was “satisfied.”

Thomas, for his part, belatedly disclosed some—but not all—gifts from Crow this year and has defended the gifts as “personal hospitality” from some of his and his wife’s “dearest friends.”

“The evidence assembled thus far plainly suggests that Justice Thomas has committed numerous willful violations of federal ethics and false-statement laws and raises significant questions about whether he and his wealthy benefactors have,” Whitehouse and Wyden wrote.

It’s been two weeks since President Joe Biden’s debate with Donald Trump and Democrats are torn over what to do about their predicament

WASHINGTON — Joe Biden’s tribulations were previewed in Hollywood days before he got on the debate stage.

At a fundraiser organized by George Clooney and packed with luminaries including former President Barack Obama, Biden was a listless figure, perhaps merely jet-lagged after flying straight from Italy but clearly not the man they knew.

Oh brother, where art thou? Clooney wondered.

It was a flashing-light moment for the actor, producer and prodigious Democratic donor and for others in the crowd. Then came the debate debacle, which set off 50 shades of panic among Democrats and pitted Biden loyalists against those now convinced a successor should take the party into November.

Two weeks after debate night, more than 15 Democratic lawmakers have called for Biden to step aside. Many more kept their newfound alarm about Biden semi-private. Mega-donors froze in the moment.

Democratic voices from Congress to the intelligentsia to the streets pitched in to tell the president he should go. He said hell no.

It’s been an excruciating reckoning, and it’s not over.

“I think we could lose the whole thing and it’s staggering to me,” Democratic Sen. Michael Bennet of Colorado told CNN. He meant the presidency and both houses of Congress, in what he worries may be a Trump landslide.

How did Democrats get here? Some boiling points and turning points along the way:

With the August Democratic convention drawing close, the June 27 debate upended Democratic officials, lawmakers and voters. Biden was befogged from the start. Voters had long felt Biden, now 81, was too old to be effective but they had never seen him like this.

Biden hadn’t been on his game for some time,

After a long flight from Italy to Los Angeles, Biden was unable to turn it on for his 30-minute onstage conversation with late-night talk show host Jimmy Kimmel and Obama at the June 15 fundraiser. One attendee who found him vibrant at an event in March was unsettled by the difference.

So was Clooney. “It is devastating to say so,” he wrote in The New York Times this week, but the event convinced him that Biden, a man he loves, should go: “He was the same man we all witnessed at the debate.”

The debate left even some of Biden’s aides questioning privately whether his campaign could be salvaged. Some longtime Biden supporters called immediately for him to step aside. But the prevailing view in the party was that he should stay for now and prove himself fit for the campaign, and fast.

He was, essentially, placed on probation in the court of Democratic opinion.

At his NATO news conference Thursday, when he displayed a command of policy that was lacking in the debate, he acknowledged he has fears to try to put to rest. “I’ve got to finish this job,” he said. “I’ve got to finish this job.”

The morning after the debate, Biden was spirited in scripted remarks at a North Carolina rally. But many Democrats weren’t shaking off what they had seen the night before.

In an email to supporters that weekend, Biden’s campaign branded the naysayers the “bedwetting brigade.”

On the Sunday news shows, Pennsylvania Sen. John Fetterman stepped up to offer a full-throated defense of the president. He, too, had epically flopped in a debate, and gone on to win.

Biden saw the cracks in his support widen in the days that followed. But, crucially, Democrats as a whole did not rush to judgment. And with each day, it becomes harder for Democrats who want him out to replace him.

But on July 2, former Speaker Nancy Pelosi lent credence to the doubts about Biden, saying she was hearing mixed opinions on whether he should stay. “I think it’s a legitimate question to say, is this an episode or is this a condition?” she said on MSNBC.

Rep. Lloyd Doggett of Texas became the first lawmaker to say Biden should go.

For days, Democrats had been imploring Biden to get out more, call more lawmakers and put himself in unscripted situations to show what he can do. “Come on, pick up the phone,” said Rep. Nanette Barragan of California, chair of the Congressional Hispanic Caucus and a Biden supporter.

Biden agreed to let ABC’s George Stephanopoulos interview him later that week. But first, he spoke with Democratic governors.

They came away sounding largely supportive of Biden. Yet the session played into public perceptions of Biden as stretched thin, as he acknowledged he needs to get more sleep and limit evening events.

In 22 minutes with Stephanopoulos on July 5, Biden avoided another train wreck like his debate. But his ill-timed pauses and meandering moments made some even more alarmed than before, because now the debate could not be written off as just one bad night.

An architect of Obama’s two presidential election victories, David Axelrod, said Biden had become “dangerously out-of-touch with the concerns people have about his capacities moving forward and his standing in this race.”

In Congress, senior Democrats held several inconclusive meetings to discuss what to do. The Congressional Black Caucus offered unqualified support and other groups circled the wagons.

On Monday, Biden sent a forceful open letter to congressional Democrats declaring: “Any weakening of resolve or lack of clarity about the task ahead only helps Trump and hurts us. It’s time to come together, move forward as a unified party, and defeat Donald Trump.”

One lawmaker who had urged Biden to quit, Rep. Jerry Nadler of New York, walked that back. There was a lull in defections. But only for a blink of time.

On Wednesday, Pelosi again weighed in. Her words were exquisitely measured but instantly taken as a setback for Biden. She dodged when asked if he should run for president again, instead saying it’s his decision to make.

In short order, Sen. Peter Welch of Vermont became the first senator to call openly for Biden to quit the campaign. This, after several others had held back from such an announcement while leaving no doubt that the president had become a liability in their minds.
