Superyacht struggle: Is Hong Kong now safe harbor for sanctioned Russians?

Luxury megayacht Nord tied to Russian billionaire Alexei Mordashov, is anchored in Hong Kong

HONG KONG — A superyacht linked to a Russian oligarch has produced the latest ripple of tensions between the U.S. and China after it moored in Hong Kong’s harbor.

Nord, a $500 million vessel connected to sanctioned tycoon Alexey Mordashov , has been docked in the city since last Wednesday after it made the weeklong journey from the Russian city of Vladivostok. 

Measuring 464.6 feet, it has two helipads, a swimming pool and 20 cabins, as well as a gym, a sauna and a cinema.  

Hong Kong said Tuesday it would not seize the superyacht, defying Washington and raising fears that the global financial hub could become a haven for people sanctioned over the war in Ukraine .

Mordashov, one of Russia’s richest men, was sanctioned by the U.S., the United Kingdom and the European Union in February, days after Russia invaded Ukraine. His company, Severstal, did not immediately respond to a request for comment about the Nord.

Hong Kong’s leader, John Lee, said Tuesday that the city had no legal basis to act on a Russian oligarch’s superyacht in the city. 

“We will comply with United Nations sanctions,” Lee said at a news conference. “We cannot do and we will not do anything that has no legal basis.”

Russia, a permanent member of the United Nations Security Council , has vetoed all attempts to take action on Ukraine, which could include sanctions against people like Mordashov. 

The State Department said in a statement Monday that it would “strongly encourage all jurisdictions to take actions under their domestic authorities to help implement sanctions imposed by the United States and more than 30 other countries.” 

It added that “Hong Kong’s reputation as a financial center depends on adherence to international laws and standards” and that “the possible use of Hong Kong as a safe haven by individuals evading sanctions from multiple jurisdictions further calls into question the transparency of the business environment.”

U.S. and European authorities have seized over a dozen yachts belonging to sanctioned Russian tycoons to prevent them from sailing to other ports that are not affected by the sanctions. So Russian oligarchs have begun docking their yachts at ports in places like Turkey , which has maintained diplomatic ties with Russia since the war began.

However, some experts predict that China will not stop Russians sanctioned by the West from registering in Hong Kong as the once strong financial hub struggles to compete in the global market, leading to fears that it will become a safe haven for Russian oligarchs trying to evade Western sanctions.  

“China is trying to restore and rebuild investors’ interest in Hong Kong,” Yun Sun, the director of the China program at the Stimson Center, a nonpartisan think tank in Washington, said by email Tuesday.

The most important consideration for Hong Kong’s authorities will be whether the city’s banks will be denied access to the U.S. financial market as a result, she said.

“Secondary sanction is more a practical matter rather than a legal or moral matter, as Hong Kong banks handling Russian transactions could be sanctioned,” Sun added. “That is the most important consideration for Hong Kong.”

China’s Foreign Affairs office in Hong Kong accused the State Department in a statement Monday of “smearing” the city's business environment. It also referred to a statement its Marine Department issued Sunday, which said that Hong Kong’s “reputation and status as an international financial center are globally recognized” and that the city maintained a “free, open and law-based business climate.”  

Lee laughed off U.S. sanctions Tuesday, calling them “barbaric.” He was himself sanctioned by the U.S. in 2020 for his role in implementing a national security law that has been criticized by the U.N. -appointed human rights committee and rights organizations.

Chinese and Hong Kong officials have repeatedly said the law was vital to restore stability after the city was rocked for months by sometimes violent anti-government and anti-China protest s in 2019.

It is unclear how much Russian money has flocked to Hong Kong because of Western sanctions. The Hong Kong Marine Department did not respond to a request for comment on the number of Russian yachts in its harbors. 

China has not backed global sanctions against Russia, and President Xi Jinping has said little about the conflict in recent months. However, officials have repeatedly urged “all parties” involved in the war to engage in diplomatic negotiations . 

“We will have to see how much money eventually flocks to Hong Kong and how they are being handled in order to assess the impact on U.S.-China relations,” Sun said.

A superyacht linked to a sanctioned Russian billionaire has dropped anchor in Hong Kong after arriving in the city on Wednesday, according to marine tracking websites. The city’s Marine Department, which grants entry to foreign vessels, has said it will not pursue action against the ship or its owners.

The 142-metre yacht Nord – said to be worth HK$3.92 billion – is tied to steel mogul Alexey Mordashov, Russia’s third-richest person as of the Bloomberg Billionaires Index on Friday. The majority shareholder and chairperson of Severstal, the country’s largest steel and mining company, has been the target of sanctions from the European Union, the United Kingdom, and the United States, imposed in response to Russia’s invasion of Ukraine .

Announcing the measures against Mordashov in June, the US Treasury’s Office of Foreign Assets Control said it was taking “action to degrade the key networks used by Russia’s elites, including President Vladimir Putin, to attempt to hide and move money and anonymously make use of luxury assets around the globe.”

Files leaked as part of the Pandora Papers revealed Mordashov’s ties to companies linked to a close Putin associate, and show how he made his vast fortune – helped by accounting firm PwC.

While a number of private yachts and aircraft have been seized as a result of sanctions – including one owned by Mordashev in Italy in March – in recent months the Nord has sailed from the Seychelles to the Russian port city of Vladivostok, where it was largely based before departing for Hong Kong on September 27.

Responding to an enquiry from HKFP, a spokesperson from the Marine Department said it “do[es] not comment on any individual cases of vessel entry into Hong Kong.”

On the topic of sanctions, the department said that the government “has all along been implementing and enforcing fully the sanctions imposed by the United Nations Security Council.” However, the spokesperson added that Hong Kong “does not implement, nor do we have the legal authority to take action on, unilateral sanctions imposed by other jurisdictions.”

Hong Kong’s Chief Executive John Lee, Chief Secretary Eric Chan and security chief Chris Tang, as well as former leader Carrie Lam and several other high-ranking officials, were hit with US sanctions in August 2020 for “undermining Hong Kong’s autonomy.” Those on the sanctions list were quick to dismiss the impact of the action , with saying they did not have assets in the US.

According to Bloomberg, Mordashov is not currently aboard the vessel, which has two helipads, five decks, a cinema and 20 guest cabins.

Visiting yachts have to undergo “port formalities” when entering Hong Kong waters, including gaining permission of the Director of Marine, and can stay for up to 182 consecutive days. A list of all on board, including passengers and crew, must be provided for immigration procedures.

Hong Kong to ease its restrictions on superyachts

The government of hong kong has agreed, in principle, to relax its restrictions on private yachts visiting the region – although a formal agreement is yet to be reached.….

Following efforts from a collection of the Asia Pacific Superyacht Association’s (APSA) members - Expat Marine Insurance, Lodestone Yachts, Anglo Easter Ship Management, Camper & Nicholsons Marinas, Benetti Asia and two private superyacht owners – the government of Hong Kong has agreed, in principle, to relax its restrictions on private yachts visiting the region – although a formal agreement is yet to be reached.

At present, according to Section 8 of the Merchant Shipping Regulation, foreign superyachts visiting Hong Kong are unable to navigate in Hong Kong’s waters unless they have qualified for a cruising license. However, in order to qualify for a cruising license the yacht must be entering a shipyard for repair, in Hong Kong to race or be changing its berthing. Additionally, the vessel would need produce a third-party risk insurance policy to cover no less than HK$5,000,000.

“Traditionally there has been no real provision for private yachts in Hong Kong,” explains Nigel Beatty, chairman of APSA. “There has been no distinction between foreign vessels entering Hong Kong, whether it is a large merchant ship or a superyacht, and it is a shame because there are some beautiful places to cruise, especially in the new territories.”

As a result of APSA’s aforementioned members’ direct involvement, the government of Hong Kong has agreed, in theory, to allow visiting superyachts cruising licenses, provided they meet certain conditions. These conditions include:

  • Submitting a Pre-Arrival Notification for the vessel
  • Appointing a local agent with legal responsibility for the vessel
  • Submitting comprehensive photographs of the vessel beforehand
  • Possessing all the necessary safety and pollution certificates
  • Participating in the Vessel Traffic Service of the Hong Kong marine department 
  • Complying with specific traffic control measures
  • Not engaging in charter, unless an agreement has been made before the vessels visit
  • Possessing a third-party risk insurance policy
  • Maintaining safe manning standards
  • Possessing recognised navigational qualifications

Hong Kong’s Immigration Department has also applied measures that will make visiting Hong Kong far easier for superyacht crew. Individuals that require visa’s will now be able to remain in Hong Kong until their superyacht leaves, provided working on the vessel is the sole reason for their visit and that they abide by the normal immigration requirements.

Some recommendations for day trips on the water are described below. Combining boating and land based sightseeing in any trip is what makes Hong Kong so special as a superyacht destination.

The different islands are all connected by local ferries which is a must do in itself. None of the distances are far and public transport and taxis are readily available and every island has helicopter access.

Anchor off in any of the multiple protected bays of the following islands which offer simple seafood restaurants:

  • Lamma Island – opposite Aberdeen; two bays with restaurants connected by a pleasant hike
  • Lantau Island – with high mountains, beautiful trails and long beaches where you can indulge in kite surfing, eating, visiting local villages and the big bronze buddha (and airport)
  • Peng Chau Island – a horseshoe island steeped in local tradition
  • Cheung Chau Island – with its many local fishing boats and shipyard, it is famous for its bun festival with friendly local fishing folk. Cheung Chau hosts an eclectic variety of inhabitants including San
  • San Lai Island – the Olympic windsurf champion who has a school here.
  • Po Toi Island – a hangout for the local sailors where the sea is very blue due to the start of the South China Sea
  • Sai Kung Island – hidden up in the stunningly beautiful north east territories, now a bustling little city in itself, looks like Saint Tropez some 15 years ago with local pleasure junks coming and going. Along the pubic quayside you can choose your own live fish to be prepared for you.

Hong Kong is famous for its hiking trails and there are numerous monasteries, waterfalls and historical places of interest. For the geologists there are outstanding rock formations on the Nine Pin Islands.

During any given weekend, the three major yacht clubs organise various sail races for big and small boats in at least 2 distinct areas: Middle Island, Hebe Haven and most weekends in Victoria harbor as well.

Day Trip Suggestions

Day 1 Try the Central and Western district walk which will lead you through Hong Kong’s most famous art galleries near Hollywood Rd. and Man Mo Temple. Remember to catch a ride on the longest escalator in town, linking Central to Mid-levels. Round up the evening with a cruise through Victoria Harbour whilst enjoying ‘A Symphony of Lights’.

Day 2 – Lantau island Visit the biggest Buddha with Ngong Ping Cable Car, Cheung Chau Island (Lunch), Cocktails in one of the art galleries.

Day 4 – Trip to Macao Portugese History, Circle du Soleil or Dancing on Water Show, Venitian Casino and dinner can provide a wonderful trip.

Day 5 – Hong Kong Flagstaff Museum (Hong Kong Park) or Maritime Museum. The maritime museum is a little gem and is situated next to the Star Ferry.

Brand new innovative wakesurfing boats. Now available in Hong Kong.

As wakesurfing rises in popularity in Hong Kong, even surpassing wakeboarding – a similar, yet fundamentally different sport – surfing boat manufacturers have taken the opportunity to modify, refine, and upgrade their boat designs. Unlike wakeboarding, wakesurfing requires a particular set of features, such as a different engine placement and hull shape, alongside innovative and advanced equipment to provide an enjoyable, safe, and unforgettable wakesurfing experience.

The main difference between wakesurfing and wakeboarding is that with wakesurfing, you aren’t permanently attached to the boat via a rope. Wakeboarding gained popularity thanks to being an invigorating and fun sport in which you travel at high speeds across the water behind a boat. Wakesurfing is typically a slower – but by no means easier – sport in which you surf in the waves made by the boat’s engines. This provides surfers in Hong Kong with much easier and guaranteed access to surfable waves, provided the boat is designed correctly.

The design of the boat

The design of wakesurfing boats differs from wakeboarding boats in that there is a greater emphasis on your safety. Rather than jutting out of the back of the boat, the propellers are located on the bottom – safely out of reach of anyone in the water.

In addition to this, boats with a convex V-shaped hull ride deeper in the water, creating a bigger and more surfable wave. This is different from boats with flatter hulls that might be better for water skiing, for example.

Depending on the model of the boat, there is ample storage and a luxurious cockpit with plenty of space to move around in. There is also plenty of ballast weight on the boat for extra security without sacrificing any storage space.
