On Wednesday, February 9, the Intracoastal Waterway in the City of Fort Lauderdale will be transformed into South Florida’s most expressive art show on the water. Get ready for StAR.

A theater of street and pop art featuring competitive sailing!

The Street ARt Regatta also known as StAR is an interactive art installation featuring youth sailing teams guided by award-winning coaches based at the Lauderdale Yacht Club Sailing Foundation (LYCSF).

The annual installation sets sail in front of LYC showcasing competitive racing tactics ‘choreographing’ the boats and painted sails. The Project is presented as a collaboration of Grace Arts Center, Inc. (GAC) and Lauderdale Yacht Club Sailing Foundation (LYCSF).

“StAR is the culmination of many years of working with artists beyond gallery walls to revitalize neighborhoods and engage communities through art and innovative conceptual projects. The Artists envisioned ‘dancing on the water’ painting unique original images on each side of sail canvases. This year New River Fine Art painters, Tom Rossetti and Andrew Cotton, interpreted the glamor of Hollywood beaches and sailing in their own brilliant way with direction from Gallery owner, Lisa Burgess,” said Clare Vickery, Director of Grace Arts Center, StAR co-curator.

In 2006, GAC commissioned the late Miami Florida Hall of Fame Artist, Purvis Young, to paint thirty-foot sails for the Winterfest Boat Parade. The Artist’s iconic images appeared to move across the sail canvas pressed by the ocean breeze. In 2020, local, national and international artists joined a new non-profit initiative creating walkable galleries in South Florida communities painting murals across city blocks to revitalize neighborhoods.

Stefano Alcantara, Jay Bellicchi ‘Remote,’ ‘Buns,’ ‘Hoxxoh,’ ‘Hiero,’ ‘Orla,’ Lori Practico, ‘Ripes,’ Isanusi Garcia Rodriguez, Tom Rossetti, Suzanne Scherer, ‘Surge,’ Laura Tan, and NY-based ‘Lady Pink’ and ‘El Cekis’ with London native Andrew Cotton painted unique original compositions on sail canvases.

Several painters who are not part of the street art community responded to StAR’s creative challenge including Isanusi Garcia Rodriguez, a retired professional ballet Principal of the Miami City Ballet, recovering from injuries through painting therapy. He worked with Painter and Art Educator, Laura Tan, to create a stunning two-sided sail available for purchase during the auction that follows the free afternoon regatta.

Ways to support and enjoy StAR

The free sailing event on the afternoon of February 9, 2022, is followed by an art auction sponsored by GAC, Lauderdale Yacht Club Sailing Foundation with generous support from individuals, artists (and artist collectives such as Galera Collective), and organizations including the City of Fort Lauderdale Parks and Recreation Department, New River Fine Art Gallery and Quantum Sails.

The StAR auction features five (5) original sails painted by local and international guest artists. Auction details will be updated on January 10, 2022, on this registration portal including social media and ticket purchase information. The evening art auction occurs immediately after the public event at Lauderdale Yacht Club to benefit student sailing and art scholarships.

Street Art Regatta 2023: Celebrating the fusion of artistic expression and athleticism in Fort Lauderdale

On April 7, 2023, the Lauderdale Yacht Club Sailing Foundation’s award-winning youth sailing team will present the Street Art Regatta (StAR) at the Fort Lauderdale Intracoastal Waterway. Local and national artists will paint original artworks on sail canvas for this celebration, which promises to be a visually-stunning experience.

This event is being presented by the award-winning youth sailing team of the Lauderdale Yacht Club Sailing Foundation. The free interactive art installation, set against the docks of the gorgeous Lauderdale Yacht Club, is a mesmerizing display of fantastical sea creatures in a water ballet, promising a visually-stunning experience for all attendees. Those who are unable to attend in person can enjoy the event virtually on Facebook and YouTube.

Connie Commette, a Lauderdale Yacht Club Sailing Foundation volunteer, remarked, “We are proud to partner with Grace Arts as we showcase the skills of our young sailors along with such spectacular art pieces.”

StAR brings together the athleticism of sailing with the vibrant culture of street art, making it a unique and exciting way to appreciate the beauty of both worlds. Spectators can watch the brightly colored images that captivate audiences through freestyle spins and twirls. The event will showcase the beauty of Fort Lauderdale’s coastal community, known as the ‘Venice of America.’ Year after year, more art and sailing enthusiasts marvel at the stunning fusion of sailing and artistic expression.

Clare Vickery of Grace Arts Florida, the Curator and Presenter of StAR, said, “The StAR event is sure to delight art and sailing enthusiasts alike, bringing together the beauty of both worlds in a unique and exciting way.”

The Street Art Regatta 2023 boasts exciting new designs, including a tribute sail by longtime graffiti artist ARTYEK, aka STROKE, to local sailor Emilio Bocanegra, who won the Optimist National Championship in Oregon in 2022. STROKE’s design evokes the energy and power required for competitive sailing and the thrill of victory, making it a fitting tribute to Emilio’s achievement. STROKE, a self-taught painter born in Chile and inspired by Kustom Kulture, has been a vendor for famed Brazillian Artist Romero Britto for over a decade. He’s worked on numerous high-profile projects for Gunther Volkswagen and Volkswagen of America. STROKE’S Fort Lauderdale studio has become a haven for young artists, and he recently joined the eponymous MSG (Miami Style Graffiti) Crew.

In April, two new taller radial sails, painted by five female artists from the Museum of Graffiti in Wynwood, will join the StAR crew. Museum co-founder Allison Freidin says that the artists—REDSKEE, DELVS, DIDIROK, NICO, and LUSHY—are considered some of the best in the business. Their collaborative design focuses on the interaction between humans and water, with outstretched arms, flying birds, and butterflies, and features a stylized graffiti background with conservation messages.

“LYCSF’s best women sailors will captain two boats leading the entire fleet with this masterpiece,” Vickery said.

The event will be held on the Lauderdale Yacht Club East Lawn, located at 1725 Southeast 12th Street Fort Lauderdale, FL 3331. Seating for the event is limited, but there will be a preview show for those unable to attend in person. TV Personality Cynthia Demos will host the live coverage of the event, which will be streamed on Grace Art Center’s YouTube Channel and Facebook.

StAR captains will perform daring and exciting tricks that are not permitted during racing, adding an extra level of excitement to the event. This incredible display of athleticism and artistic expression is not to be missed!

FORT LAUDERDALE, FL – (January 26, 2022) – Grace Arts Center (“GAC”) announces the 2nd Annual Street Art Regatta (“StAR”) to take place on Wednesday, February 9, 2022, at 4:00 p.m. The event is free and open to the public and sets sail from Lauderdale Yacht Club located at 1725 SE 12th Street, Fort Lauderdale, Florida. StAR is an interactive installation that transforms the Intracoastal into a floating theater of street and pop art and competitive sailing. The Regatta will be live-streamed https://www.facebook.com/GraceArtsFL.

“Bringing together street art and the marine industries in a visual display of expressive art on the water was the basis for StAR. Street Art thrives because it has a visceral connection to the ‘street’ with origins in historic hip hop and contemporary pop culture in America. A Regatta is a competitive race with a storied Venetian context involving elite events, extreme athleticism, and the grandeur of traditional boating,” says Clare Vickery, Founder and Director of Grace Arts Center.

The Street Art Regatta is an opportunity for young athletes in the smallest racing class of sailboats, the Optimist series, to use tactics that might otherwise be sanctioned during the sailing competition to maneuver or choreograph painted sails of massive human leaping legs to make the sailboats appear to dance along the water.

“Fort Lauderdale is all about art, culture, and coastal living. What a treasure,” says Mayor Dean Trantalis, who will be on-hand to serve as Starter of the race.

The artists had one directive – paint as if the ocean surface were a floor for human movement. The outcome is a dance on the Intracoastal waterway managed by the professional instructors of the Lauderdale Yacht Club Sailing Foundation.

Each boat will be piloted by one youth during the 45-to-60-minute program. Skill level determines who can participate. Most are age 10 to 13 and are training to compete in national and international regattas.

“Quantum Sails is excited to be among the sponsors of StAR, a unique combination of art, sailing and philanthropy. This event brings visibility for sailing to new eyes in the diverse art world and promotes growth in youth sailing through scholarship,” says Libby Tomlinson, Merchandise and Event Coordinator.

This year features 16 Street, Pop, and Abstract painter collaborations, some in duos, who will have their original paintings expertly reproduced on sails that will fly from the masts of boats sailed by teams of young people departing from the newly renovated and historic Lauderdale Yacht Club (“LYC”).

“Our in-kind support furthers our mission to provide more access to sailing for residents,” says Phil Thornburg, Director, City of Fort Lauderdale, Parks & Recreation Department.

The interactive art and sailing event cruises the Intracoastal Waterway in the City of Fort Lauderdale. Youth sailing teams actively participate in StAR’s art installations waving vividly on the masts. The teams are guided by award-winning coaches based at the LYC Sailing Center, who choreograph the boats and painted sails using competitive regatta racing tactics.

New this year is an auction of five sails that will take place at the Lauderdale Yacht Club following the Regatta. Dr. Harry Moon, a beloved local physician, art collector and member of the LYC will be the Master of Ceremonies and the auctioneer. Dr. Moon is the Chief Operating Officer of NSU Florida, the NSU Museum of Art (formerly the Fort Lauderdale Museum of Art). The auction and dinner tickets are $75 per person and may be purchased at https://lycsf.org/star-art-auction-dinner.

Proceeds from the auction will provide sailing scholarships for youth without access to boating activities provided by LYCSF. This year, a new student travel abroad scholarship for seniors accepted to college art programs will be awarded by GAC.

An NFT (Non-Fungible Token) drop of one of the sails will be launched to raise additional funds for sailing and travel abroad scholarships as directed by Grace Arts Center.

Following the Regatta and Auction on February 9, a selection of the sales will be exhibited at the new Southside Cultural Arts Center located at 701 S. Andrews Avenue, Fort Lauderdale, FL 33316.

“I really like the idea of bringing street art to the sails. Showcasing street art and graffiti this way helps broaden the horizon for the artists,” says Glayson Leroy, Founder of Galera Collective and one of the sponsors of StAR.

The 16 artists who hail from near and far, many making their homes in South Florida, include Stefano Alcantara, Jay Bellicchi “Remote,” Buns, El Cekis, Andrew Cotton, Hiero, Hoxxoh, Lady Pink, Orla Ananda, Lori Practico, Ripes, Isanusi Garcia Rodriguez, Tom Rossetti, Suzanne Scherer, Surge and Laura Tan. De-commissioned racing sails are given a second purpose as canvas for original artworks and used as part of a water performance furthering the found-object-as-fine-art legacy of Mr. Young. He passed away in 2010 but his artwork, generosity of time and spirit lives on in South Florida and beyond through high profile art projects by self-taught artists that beautify neighborhoods.

“Repurposing retired racing sails reflects the legacy of Purvis Young. Freestyling sailing and youth culture appeals to Street and Pop artists. StAR creates new relationships with the water and boating in Fort Lauderdale and elevates the nature of how we are integrating fine art into community events,” says Vickery.

Street Art Regatta puts Wynwood graffiti art on the water

If you’ve ever wandered around Wynwood, you know how cool street art can be. It’s even cooler when that art is plastered on the sails of boats doing crazy stunts. It gives a whole new meaning to the term: “art for sail.”

Mix hip street artists with the freestyle talents of young sailors, and you get the Street Art Regatta.

Clare Vickery: “It’s an opportunity to exhibit interactive art in a visual way both on the water and to showcase some of the region’s and actually the nation’s top competitive sailing teams that are coming right out of Fort Lauderdale.”

These boaters use the intracoastal waterway at the Lauderdale Yacht Club as their own personal playground.

Clare Vickery: “We have competitive youth sailing teams competing against each other to sort of outdo each other in the spins and the maneuvers and the tacks.”

With the wind blowing into all the colorful sails, it’s an art show like no other.

Clare Vickery: “And a lot of the young up and coming sailors can take the beautiful printed sail versions of the artwork on the water. The images look as though they’re dancing on the water and spinning.”

Seeing her work on a sail instead of a wall is a brand-new experience for local artist Didi Contreras.

Didi Contreras: “I’ve never had anything like painted on a sail before, never had anything floating on the water like that, and I feel so excited already.”

Didi’s one of six local female artists who combined to turn out this beauty.

Didi Contreras: “We quickly came up with an idea, and then we tried to incorporate everybody’s style into the piece. My part of it is the girl on top of the dolphin, the ballerina girl and also the fish and the butterfly so mostly all the pink.”

From the pink in the painting to the blue of the water, take it from a sailor, you’ve just gotta regatta.

Jake Taubman: “It’s really about expressing art right. It’s sort of a dance on the water, almost like a ballet of sorts. I’m glad that I get to represent the art on my sail.”

Prepare for a Spectacle: The 2024 Street Art Regatta (StAR) will Showcase Record-Breaking Youth Participation and a dazzling array of painted sails, featuring 50 Designs by local and national artists.

Set against the picturesque backdrop of the Intracoastal Waterway, the 2024 Street Art Regatta (StAR) produced by  Grace Arts Center,  a South Florida Non Profit Arts Advocacy Organization, promises an unprecedented celebration of athleticism of youth sailing and coastal parks. This year, StAR proudly announces its largest gathering of sailing teams to date, accompanied by a stunning array of painted sails, quadrupling the artistic fervor of previous editions.

The General public can join in the  free activities  by entering the Hugh Taylor Birch State Park off East Sunrise Blvd. and driving around the park to the westernmost section along the Intracoastal Waterway.

At Birch State Park guests can bring blankets, chairs and picnic along the grassy area near the sea wall to enjoy the 1 hour interactive art exhibition on the water. A  small fee  to enter the park is required which helps to maintain the parks’ many amenities.

After the event, park guests can enjoy the restaurant in the park situated along the ocean all within a short drive.

Yvette Michelle is awarded first place at the ninth annual Lauderdale Yacht Club Fine Art Fair

       FORT LAUDERDALE, FL — Las Olas Capital Arts is pleased to announce that the first artist to be exhibited in the Las Olas Capital Advisors office, Yvette Michele, was awarded with the First Place ribbon at the Lauderdale Yacht Club Fine Art Fair.

Yvette earned this phenomenal award in a com-petition with over 30 other artists. Her work can be noted as delightfully different through her use of three-dimensional abstracts created from raw canvas and oil.

Yvette participated in the Ninth annual Lauderdale Yacht Club Fine Art Fair.  Lauderdale Yacht Club has become an advocate of the arts in Fort Lauderdale.  Fort Lauderdale continues to produce a flourishing and evolving community that supports local artists.

Yvette Michele specializes in large works of botanical and life abstractions. Within Yvette’s Art Portfolio are the St. Croix King Series, Le Fleur – The Exotics, The Original Sculptured Canvas, Le Fleur – The Roses, and Le Femme Portrait Series. Yvette also specializes in photography, especially of her beloved country of Bermuda.

The work of Yvette Michele brings life to the walls comprising the Las Olas Capital Advisors office.

A reception celebrating the exquisite work of Yvette Michele will be hosted at the Las Olas Capital Advisors office in Fort Lauderdale.

Street Art Regatta and Auction Weighs Anchor on February 9, 2022.

The inaugural Street Art Regatta Auction sets sail IRL and virtually at 7:00 p.m. ET on Wednesday, February 9, 2022.  The one-of-a-kind sails will be auctioned simultaneously here on The Auction Collective and live in Fort Lauderdale, FL at the Lauderdale Yacht Club.  Five of the life size sails created for the Regatta itself will be up for auction by artists Stefano Alcantara, Orla Ananda with Lori Practico, Andrew Cotton, Isanusi Garcia Rodriguez with Laura Tan and Tom Rossetti.  Proceeds from the auction will provide sailing scholarships for youth without access to boating activities provided by Lauderdale Yacht Club Sailing Foundation.  This year, a new student travel abroad scholarship for seniors accepted to college art programs will be awarded by the Grace Arts Center.   The Regatta will be livestreamed, here .

The artists, whether street, graffiti, or pop, had one directive – paint as if the ocean surface were a floor for human movement. The outcome is a live dance along the Intracoastal waterway of sail boats managed by the professional instructors of the Lauderdale Yacht Club Sailing Foundation.

StAR is an interactive installation that transforms the Intracoastal into a floating theater of street and pop art and competitive sailing. The in-person Regatta is free and open to the public and sets sail from Lauderdale Yacht Club located at 1725 SE 12th Street, Fort Lauderdale, Florida. Registration is required via Eventbrite, here .

Dr. Harry Moon, a beloved local physician, art collector and member of the LYC will be the Master of Ceremonies and the auctioneer.  Dr. Moon is the Chief Operating Officer of NSU Florida, the NSU Museum of Art (formerly the Fort Lauderdale Museum of Art).   The auction and dinner tickets are $75 per person and may be purchased, here .

The 16 artists whose work is featured in the Regatta include Stefano Alcantara, Jay Bellicchi “Remote,” Buns, El Cekis, Andrew Cotton, Hiero, Hoxxoh, Lady Pink, Orla Ananda, Lori Practico, Ripes, Isanusi Garcia Rodriguez, Tom Rossetti, Suzanne Scherer, Surge and Laura Tan.  

Founded in 2011 by Clare Vickery, Grace Arts Center (“GAC”) is a 501c3 nonprofit organization that presents original material including theater, art exhibits, humanities and science events/scholarships and urban design engagements.  The Grace Arts Center (GAC) mission is to network and connect three distinct areas of general programming resulting in more extensive cultural collaborations and revitalization of South Florida communities through the arts and humanities.  Projects feature exhibits, performances, and urban design by leading Innovators of multiple disciplines to entertain and inform the public and participate in social justice initiatives.  Each program supports annual outreach to lower income communities with less access to cultural experiences and the liberal arts.

The Lauderdale Yacht Club Sailing Foundation (LYCSF) is dedicated to favorably impacting the lives of young people from all social and economic backgrounds through the sport of sailing. LYCSF provides learn-to-sail scholarships, grants for competition, and a camp for Gold Star children who have lost a parent who was serving in the military.

Proceeds from the auction will provide sailing scholarships for youth without access to boating activities provided by LYCSF. This year, a new student travel abroad scholarship for seniors accepted to college art programs will be awarded by GAC. Fun times on Labor Day!! Quite the Labor Day party set up!! Had a great time -- ANYONE would!! $35 all you can eat bbq with Margarita Cart, Beer Keg in pool on rowboat, alcohol-infused popsicles! There was a chocolate slip-n-slide for the kids. Fun times with M&M!

Really awesome spot on the pavilion. Sylvia suggested a raspberry margarita because I like sweeter drinks. It was probably the best margarita I have had in a very long time. She was really nice and wanted to actually have a conversation with me. She made our experience awesome.

Best salad bar in town! Everything you can imagine that should be on a salad bar is here, I loaded my plates with mixed greens, tuna salad, beets, hard boiled egg, garbanzo beans, cucumbers, and many varieties of seeds ( pumpkin, sunflower). Ducked in so my business partner, Marnie, could receive her Golden Mouse Award for Excellence in Social Media Marketing. Excellent service. Beautiful day. We were in the main ballroom for lunch. The food was delicious. The portions were fair. Dessert was awesome. The salad was better than expected. My only complaint, was my main course was cold. I ate it. The exclusive LYC has been serving up great drinks, good food, and memorable times for decades. Located in the Rio Vista neighborhood just north of the 17th Street Causeway, I have been to the LYC on several occasions for lunch, company holiday parties, and friendly get togethers. The catering staff is AMAZING - they will accomodate the most discerning of guests and will go out of their way to ensure that your party is satisfied. I have tried the caprese salad (delicious!) as well as the filet with leeks & demi glaze, served with veggies and potato (also delicious!). The conch chowder is also very very good - try it with a splash of sherry to compliment the flavors of this soup. Overall everything is fresh and tastey, the grounds are well kept and the Club is nicely landscaped & a perfect setting for a casual afternoon on the water or an elegant evening event.

In Retrospect: The Club Life

A legacy of accomplishment, a passion for the science of sailing and a tradition of civic outreach through grants provided by its nonprofit sailing foundation make the Lauderdale Yacht Club a gem on the Fort Lauderdale landscape. 

Turn back time 81 years to 1938, the first year of its existence. A group of 100 original members paid $100 each to join, and annual dues were $24. Five years later, membership had risen to 200. Today, with nearly 1,000 members, Lauderdale Yacht Club has earned Platinum Club of America status, a recognition that places it among the elite private yacht clubs in the nation.

“It’s one of the highest designations in the private club world, and due to the efforts of our wonderful membership, we checked off all the boxes,” says Nadine Rockwell, general manager of the club. “Criteria included universal recognition, superb amenities, levels of service, quality of membership and management, and the ability to adapt to changing times.” 

Lauderdale Yacht Club’s history began when Avylen Harcourt Brook, a successful New York ad agency executive, retired to Florida in 1919. An avid sailor and commodore of the Jamaica Bay Yacht Club in New York, he became a member of the Atlantic Deeper Waterways Association in 1920 and the Florida Inland Navigation District. Coastal states from Maine to Florida lobbied Congress to create an Intracoastal Waterway. “The states wanted safer conditions, lighted buoys and dredging so that a waterway could be competitive with railways as an alternative means of transportation for both goods and people,” says Rick Burgess, the yacht club’s fleet historian. “In 1935, the Intracoastal Waterway was completed from Miami to Trenton, New Jersey.”  

Fort Lauderdale’s unique topography of inland waterways and canals was perfect for boating and sailing, and Brook and Harlow Davock spearheaded efforts to organize the Lauderdale Yacht Club. “Sailing and yachting became a craze for the upper class after the Great Depression,” Burgess says. “South Florida was a paradise for boating and sailing, and magazines promoted the area as the ‘Yachting Capital of the World.’” 

Lauderdale Yacht Club’s upcoming renovation is assessed in the neighborhood of $17.5 million, and project completion is set for next fall. “The majority of work will include renovating the existing clubhouse and expanding clubhouse facilities and amenities,” says Commodore John Dunn. “We will also be enhancing the south parking lot and adding additional bathrooms near the pool. The future of the club is very bright.”

A Class Sailing

The A Class Catamaran is the fastest single handed small catamaran in the world. This highly responsive lightweight boat is a joy to sail. The powerful rig means that even the heaviest sailors are on the trapeze upwind in 6 knots of breeze and flying a hull downwind (wild thing). The top sailors in the class have now mastered the art of trapezing downwind, making the boat even faster and more exciting. The boat is very easy for an experienced sailor to sail, but very difficult to sail really fast.

The A Class is a boat built specifically for racing and has very strong fleets both in Australian and overseas. The National Championship in 2011 had a highly competitive fleet of 73 boats, the largest catamaran fleet in Australia. State Championships in Qld, Vic and NSW all had over 30 competitors. Australians consistently perform well at the world championships, in 2010 taking 5 of the top 10 places, including the top 3.

The high quality of racing in the A Class often surprises those new to the class. Regular competitors include Olympic medalists and world champions in several other classes. At recent Australian National Championships, several professional sailors from Americas Cup teams have been shocked to find themselves mid-fleet, although others like Dean Barker and James Spithill have shown their ability to perform at the top of any fleet.

The A Class catamaran is a development class with very simple rules defining the boat. The key rules are:

Several competitive designs of A-Class are commercially available, although which boat is the fastest changes as these products are constantly improved. 50 years of development have produced a very refined boat, so changes are typically incremental and boats usually remain competitive for several years.

Business | south florida yacht brokers hit with lawsuits that claim 10% commissions violate antitrust laws.

Two newly filed federal lawsuits claim that 10% sales commissions required by South Florida’s yacht broker industry are anticompetitive and violate antitrust laws.

The claims follow an October finding by a federal jury in Kansas City, Missouri, that the National Association of Realtors conspired with brokers to artificially inflate commissions paid to real estate brokers. The ruling, and a March 15 settlement by the Realtors, is expected to radically change how homes are sold in the United States.

Both lawsuits involving yacht brokers name as defendants the International Yacht Brokers Association, based in Fort Lauderdale, the Yacht Brokers Association of America, Boats Group LLC and YATCO LLC.

Also listed as defendants in both suits are a who’s who of South Florida-based yacht brokers, including Denison Yacht Sales, MarineMax Inc., Galati Yacht Sales Inc., Allied Marine Inc., Tournament Yacht Sales LLC and Northrop & Johnson Yacht Ships, among others.

Nearly all of the defendants are headquartered in South Florida.

The most recent suit, filed on March 22, proposes a class of plaintiffs that includes anyone who listed vessels on certain Multiple Listing Services using a listing agent or broker affiliated with one of the defendants and paid a buyer’s broker commission since March 22, 2020.

The lead plaintiff in the lawsuit is Kip Lamar Snell, identified as an Alabama resident. Snell entered into an agreement with Galati to sell a 41-foot Express Cruiser Sea Ray in July 2020 and ended up paying a $12,000 commission on the $120,000 sale price, the suit states. The lawsuit lists as defendants 15 brokers and six organizations that promote the yacht trade or operate Multiple Listing Services.

That lawsuit follows one filed on Feb. 29 that proposes a class of plaintiffs that includes anyone who paid a commission to a listing broker affiliated with the defendants since Feb. 19, 2020. It lists as defendants 11 brokers and five organizations that promote the yacht trade or operate Multiple Listing Services.

The lead plaintiff in that suit is Ya Mon Expeditions, a Wyoming company that paid a “substantial broker commission” when it sold a vessel in January 2023 while represented by Tournament Yacht Sales of Tequesta.

The most recent complaint accuses the trade associations of colluding with brokers to “enforce an anticompetitive restraint that requires (sellers of pre-owned yachts and boats) to pay a brokerage fee to the buyer’s broker and a total aggregate commission fee that is inflated as a condition for selling their yachts.”

The complaint states the typical commission is 10% and is shared between the seller’s broker and the buyer’s broker under terms spelled out in Central Listing Agreements provided by the brokers associations, including the International Yacht Brokers Association and the Yacht Brokers Association of America.

Only boat brokers are able to list boats and yachts on such Multiple Listing Services as YachtWorld.com, BoatTrader.com and Boats.com, and the Multiple Listing Services will not accept listings from owners who want to sell their vessels themselves, the lawsuit states.

Yacht owners are “severely disadvantaged” if they do not list their boats for sale on the listing services, while buyers suffer because their brokers are “financially incentivized” to show boats that will earn them standard “and inflated” commission rates of 4% to 5% through co-brokerage transactions, the complaint states.

None of the defendants contacted for this story responded to a request for comment, and no response has been filed yet in either case.

Robert Allen Jr., whose Miami-based law firm Robert Allen Law represents the International Yacht Brokers Association, did not respond to emails or return a phone call.

A woman who answered the phone at the International Yacht Brokers Association said, “We have no comment on that,” and hung up after a reporter asked for her name.

Of six brokers contacted for comment about the lawsuits, only Tournament Yacht Sales responded to emails. “No comment,” the company’s response stated.

Overall commissions have increased faster than the rate of inflation in recent years as the price of larger boats and yachts have increased, according to the lawsuit that lists Snell as lead plaintiff.

The result is that boat owners pay “hundreds of millions of dollars” in inflated commissions each year, the suit alleges.

Both lawsuits allege violations of the Sherman Antitrust Act that are upheld by “brokers who should be competing with one another but, instead, cooperate with each other to the detriment of pre-owned boat sellers.”

Some brokerages represent both buyers and sellers and retain the entire 10% commissions, the suits state.

The trade associations enforce rules requiring brokers to offer their boats through a listing service and to share commissions, the suits state, adding that they can impose significant penalties on members who do not comply with their rules.

Yacht purchasers are disadvantaged by the current system, the lawsuit alleges, because their agents would otherwise negotiate for their business by decreasing their commission rates.

But buyer brokers’ commissions have remained constant despite their diminishing role, the suits state. Many buyers today find boats they are interested in purchasing through online searches and enlist the services of a buyer’s broker only after identifying the yacht they want to buy, the suits claim.

The lawsuits seek an order declaring the commission structure to be illegal, a permanent injunction outlawing what they describe as anticompetitive conduct, plus damages and/or restitution, pre- and post-judgment interest, and attorneys’ fees.

Paul Geller, an attorney for one of two law firms representing the class that includes Snell, acknowledged “parallels between the allegations relating to commissions in the real estate and yacht markets.”

In the real estate matter, the National Association of Realtors on March 15 agreed to a $418 million proposed settlement that would free home sellers from paying commissions to brokers for both sellers and buyers.

After a jury ruled for the plaintiffs in the case against the National Association of Realtors in October, numerous lawsuits were filed across the country with similar allegations, including one in December against the Florida Association of Realtors and 16 brokerages.

“At bottom, the goals of (the suit against the yacht brokers) are similar: protecting consumers by challenging what we allege to be anti-competitive conduct,” Geller said by email. “We believe in the universal truth that consumers benefit by increased transparency and the competitive pricing that results from negotiated terms, including commissions.”

Food-wise, the conch chowder was truly delicious, with a tinge of spice. The raisin bread and fresh cookies for dessert were delightful. I didn't love my grouper sandwich, but the caesar salad was nice.
