This Boat Rental Company Is the Perfect Way to Step Up Your Staycation

Welcome to AFAR Approved: a deep dive into the travel items that we’re totally obsessed with, never leave behind, and can’t stop telling our friends about.

Let’s face it: This is not the summer we’d hoped to have. Countless canceled trips, parties, events . . . we can’t go anywhere! We can’t do anything! What a downer! But it’s time to take what’s left of summer into our own hands.

I live on Long Island, about an hour from New York City, and I’m never more than 20 minutes from the shore. My typical summer followed a simple equation: towels, sunscreen, beach—every chance I could get. Though local beaches have been open (with restrictions) since Memorial Day, there are still complications brought on by COVID-19. Did you know Long Island beaches reach capacity (which has been cut in half) by roughly 9 a.m. every weekend day? And once you’re there, social distancing becomes a challenge. What do you do when someone’s football lands on your beach blanket ? Can you really make your kids keep a mask on? I’ve since discovered that the best way to spend a socially distant day on the water is to actually spend it on the water—you’ve got to get on a boat.

Luckily, there’s a website for that. With Boatsetter , an eight-year-old peer-to-peer boat rental platform based in South Florida, you can book a private boat—everything from fishing boats to sailboats to fully crewed yachts—for the day (or a half day, or even a full week). Think of it like Airbnb, but for boats. My Boatsetter experience was a two-hour sunset cruise, which left from Sag Harbor and meandered around the Peconic Bay (between Long Island’s forks) . Our ride? A 43-foot Azimut Atlantis—someone’s brand-new yacht—that was large enough to accommodate me and nine guests. My brother and his girlfriend came, as did my parents, and even my grandparents—it was their biggest day out since the pandemic started in March.

This large, fancy boat came with a fancy crew: Captain Kent was behind the wheel along with his first mate, Annika. Of course, my first thought was the same as yours— you’re not supposed to be socializing with Captain Kent! It’s coronavirus! Well, on a 43-foot boat there’s plenty of space for social distancing. Kent made it clear that when we were up near the helm, or walking through the cabin, we had to keep our masks on. We could remove our masks outdoors around the people we came with, as long as we were more than six feet from him and his crew. They kept their masks on the whole time, even as Kent entertained a running list of boat questions from my grandfather (an ex-cruise ship navigator).

We were encouraged to bring food and drinks onboard, with water and ice provided, which meant we brought a typical over-the-top antipasto platter—breads, meats, cheeses, olives, the whole thing—as well as our own wine and cocktails. Yes, we shared with Captain Kent (not the alcohol, of course). After cruising around for a little while, we anchored and were able to jump off the boat for a swim before heading slowly back to the marina.

After the boat ride I felt refreshed and, dare I say it, normal for the first time this summer. It was especially nice to be able to safely bring my grandparents; I know they have been suffering from cabin fever during the pandemic.

The concept works along similar lines to Airbnb in terms of renting boats from existing owners (although it does use standalone private boating companies too). Either using its online platform or its app, you choose your destination based upon 60 countries, pick a type of boat – be it a motor yacht, catamaran or sailing boat – then choose your dates.

There’s also the option to rent for a day, short stays or long trips and knowledgeable skippers can be added to any booking, so you don’t even need to be able to sail. Ultimately, the route is your choice – the skipper is just there to advise if you need.

“It's about making boating a viable past time and activity for people today without the burden of having to own a boat,” said Borrow a Boat CEO Matt Ovenden. “We’re still pushing to get the word out as there are so many people who don’t realise that boating is open and available to them.”

Like with Airbnb, there is a huge variety of boats, from luxury super yachts to sailing boats, to cater to differing budgets, from £150 for small vessels to £50,000 for sprawling, staffed luxury yachts. The only common dominator is that each advertised boat must have passed the sailing equivalent of its MOT and commercial charter insurance.

So how easy is it to use in practice? We booked a sunset tour of the Amalfi Coast for a period of three hours and were supplied with contact numbers of a skipper and information as to what the boat looked like. At the designated time and place, a plush boat from Premium Charter Italia SRL docked up and our party of four climbed aboard. The skipper gave us insights about each attraction on the way, from the best places to watch the sunset (Praiano in case you’re interested) to famous rock formations shaped like elephants kissing. We were also given a beer on board and allowed to take it in turns to steer the yacht ourselves, which conveniently lent itself well to Instagram.

The service is expanding its offering even further with the launch of paddle boards, kayaks and sailing dinghies in the near future. These will naturally come at a lesser price point in keeping with Borrow a Boat’s ethos – sailing the seas for all. Introducing ‘Boatbound’, The Airbnb For Boats

Average boat owners only use their vessel 14 days a year. That’s why Boatbound is brilliant. It’s a peer-to-peer boat-renting startup that lets you book everything from kayaks to catamarans to yachts for a day at a time with a $1 million Lloyd’s insurance plan. In his first interview about Boatbound, founder Aaron Hall lays out his plan to make boating more accessible to everyone. Ahoy!

“The two best days of a boat owner’s life are buying and selling their boat because of all the fees in-between. It’s a big capital cost,” Hall tells me. But if Boatbound can connect owners with just a few renters a month, it could offset that cost while allowing people to share on-water experiences. “We think the third best day is renting your boat on Boatbound. You get peace of mind that your boat isn’t just eating you up financially.

Hall, who grew up boating and spent six years in a boat club, gave me the superhero origin story of Boatbound . “The idea came about when I was in Texas with family out on a lake and was trying to rent a boat. The Marina said it had four or five boats to rent but they were all booked, but there were hundreds of boats sitting around. I thought ‘there must be an Airbnb for boats,’ but there wasn’t.” (Normally we’d stay away from the “Airbnb for …” cliche , but Boatbound embraces it.)

So Hall and his designer / co-founder Matt Johnston decided to pivot their previous venture, the 500 Startups-accelerated wedding e-commerce company Tailored. That company’s wedding-focused co-founder departed, and five remaining Tailored team members formed Boatbound. After working for almost eight months and hiring Airbnb’s first employee Nick Grandy as an advisor, Boatbound is now considering which investors to bring on to a highly oversubscribed funding round. That makes sense considering everyone wants to exclaim “I’m on a boat!” without having to buy one.

Come Aboard, Matey

Boatbound plans to launch later this year, but you can request an early invite here . Here’s how it works. There are about 13 million registered boats in the U.S., and 95 percent of the time they’re unused. Boatbound offers a marketplace website where boat owners list their vessels for rent. Anyone from novices to experienced captains can browse boats and book one for a day. You can search by ship type and location, sort results by price and other factors, see descriptions of the boats, read reviews of the owner or message them, and book through a calendar widget.

Typically, a 20-foot boat that would cost $10,000-$50,000 to buy and $800 a day to rent at a marina could be available on Boatbound for $200 to $400 a day. You’ll be able to slide into kayak for just $20 to $50, or put together $15,000 to $20,000 for a yacht.

Boatbound keeps a percentage of the rental price, which helps pay for the $1 million in Lloyd’s liability insurance every boat comes with. This way both parties don’t have to be terrified of a scrape or even serious crash. If something unfortunate happens, you can call a 24-hour claims hotline just like with a car, a claims adjuster comes out, and the boat gets fixed as quickly as possible. Hall explains, “That’s the linchpin, making the boat owners feel comfortable.”

To make sure you’re capable of steering the ship, renters have to go through an identification check and outline their boating history. The less experienced are pushed to state-approved study guides. Completing an on-site course earns renters a badge on their profiles or even credit to spend.

Boatbound Boat Description

When you meet up with the owner, who Hall calls “the last line of defense,” they’ll vet you to make sure you’re ready, and it’s ultimately their decision whether to hand over the keys. Once you’re good to go, the owner gives you a brief tour of the boat to note where the lifejackets are and any tricks or other critical info. If necessary, Hall says, “there’s an option for renters to charge an extra $50 or $100 to do a quick on-boat training, so the owner can show you exactly how to drive it.”

“Our focus is to keep this as safe as possible,” Hall stresses. Luckily, common sense usually disuades people from booking boats that are out of their league, the same way you wouldn’t rent a stick-shift Porsche you didn’t know how to drive on “carBnB” service Getaround . “We have a code of conduct,” Hall tells me, that includes a two-way review system to make sure boats come back clean, gassed up and unharmed. Accidents happen, but “if we find out a renter is out there terrorizing the water, we have no problem suspending them.”

“Right Now It’s A Rich White Man’s Sport”

Hall hopes to open the waters to a whole new class of boaters. “People either think it’s too expensive or they don’t know how to boat, but we want to lower the barriers and get it on the short list of things to do on the weekend. Right now it’s a rich white man’s sport. We want to make boating kind of non-elite…by tapping a younger, more diverse demographic.”

Boatbound is trying to forge an “Ahoy Culture” in part by taking hints from Lyft’s pink mustaches and fist-bumps. “When you rent, everyone gets caps with the Boatbound logo. It’s about saying ‘Ahoy!’ and waving, telling the story of the boat and how it was named.”

A few companies, including Fun2Rent and Incrediblue, have already dipped their toes in the space, and since Boatbound joined AngelList last month, Hall says clones are already popping up. What sets Boatbound apart, though, is what Hall calls a “first-of-its-kind product with Lloyd’s.” He implies boats listed elsewhere wouldn’t be as well-protected.

Typically a boat owner’s insurance is void if they take money for a rental. “We had to put together a program that would act as the primary insurer of boats.” Hall mentioned it took the rise of Airbnb and some pushing by some high-influence individuals (maybe some of its investors), to get Lloyd’s to agree to the plan. While different boats and renters would cost more or less to insure, at least at first Boatbound is just absorbing the fees.

Convincing boaters to put their ‘babies’ in a stranger’s hands could be a tough sell. Some just won’t think its worth the money to have to worry about their ship, which could cause shortages on the supply side. Boatbound will have to do everything in its possible to avoid an Airbnb-esque disaster with a sunk boat and injured passengers.

There are 75 million boaters in the U.S. each year. I think there’s about to be a whole lot more. Since I spoke with Hall, whenever I’d mention the company to people, their eyes would light up. They either wanted to invest, or set sail immediately.

Renting a car or a place to sleep is standard. Renting a private jet is just too pricey. But Boatbound brings giddy decadence to the average joe through collaborate consumption. Something so fun shouldn’t be reserved as a status symbol for the wealthy. You deserve a day on the water, surrounded by friends with the sea spray in your face, and Boatbound is going to give it to you.

How does Renting boats work?

Curious about those who rent boats with their lake homes. We have a lot of requests for referrals to boat rental places or queries about whether we offer a boat. We have been considering getting a pontoon to rent with the cabin. How has that worked for those of you who do? I worry about liability, damage to the boat or docks, or inexperienced or inebriated guests running over swimmers or paddle boarders or kayakers, for example. How do you handle the fees for renting a boat? Through the site? Or is it separate, cash or check? Thanks- we are new to hosting!

I say this as a former boater. I used to live on a 36’ Trojan Sportfisher.

I’m not trying to rain on your parade. If I were to buy a boat, I would consider this for helping pay for it BUT People are idiots when it comes to boats, water & alcohol. Don’t trust anyone who tells you they know how to drive a boat and they won’t drink while cruising.

I can’t tell you when but someone will get hurt. Or if you are lucky, they will only run your boat aground on rocks thus tearing out the bottom of a pontoon.

Stone cold sober, I slipped & fell between the boat & dock. Scary. Painful. I hit the dock with my back & thighs with the edge of the swim platform.

Locally pontoon rentals come with a captain & limit of 6 people, $400/halfday plus tax & gas. Depending upon boat horsepower & if weekend afternoon cost $599 pls gas & tax.

Find a local boat & jet ski rental place & get your guests a discount.

Now that I’ve sounded like your mother wagging my finger & preaching, you are an adult. My words are out of protective concern.

It’s your boat. If you are ok with the risk, talk to a local boat rental for pricing & who their insurance is with.

Skip the boat and buy two kayaks, have guests sign waivers. I think a boat is a big expensive and I’m sure guests will somehow break it.

I have two kayaks that guests utilize and they always manage to break the buckles, straps or lose paddles. It gets to be a bit expensive having to buy buckles, straps and paddles but it’s a lot cheaper than costly boat repairs.

I’ve been considering buying a canoe, that might also be a good idea for your lake property.

You’re right to worry. We wanted to add simple amenities like bikes and paddleboards but our attorney strongly advised against it. The liability situation is horrendous when you think about it.

Now, if guests want to rent a bike, paddleboard, kayak etc. I direct them to a licensed and insured local business.

Much better idea to turn them on to local boat rentals, which already are insured for that. Approach one or some, establish a relationship with them, let them know you can send a lot of business their way, ask for some brochures to put in your rental, and see if they’d be willing to provide some discount coupons for your guests.

Guests will be appreciative, local business will, and you don’t carry the risk.

if you do it, should be entirely separate LLC company, with ID collection, security collection, iron clad contract and appropriate insurance. . I would never tie such a thing to a stay. Too much liability.

Renting boats doesn’t work. Just ask your insurance agent about how much the liability coverage would cost, and how much it would cover. Boats, bikes, motorcycles, 4 wheelers… all encourage reckless behavior when folks are on vacation, especially from younger folks who think they are immortal and the middle aged “hold my beer” types.

Think about whether you want to risk your entire net worth, plus your income for almost forever, on the boating or bicycling behavior of one of your guests. I don’t, and I’ll bet that you won’t either.

I rent a home with family every year. It offers kayaks. My brother-in-law had a fall helping get them in the water last year. Fortunately he was just sore and nothing was broken. I capsized the kayak and fell in twice last week. Neither of us was drinking, lol. Leave the boats to people with insurance!. If you go ahead waivers might offer some protection but it won’t help with the beat up boat and dock.

Thank you. It is so confusing for we newbies, lol. We are waaaayyy up north in Wisconsin. A good proportion of comparable properties offer boats, about half of those include them free. We have heard nothing but horror stories! Unfortunately, around here there are really no boat or jet ski rental companies, just a few people who sort of do it off the record. The closest companies are 45 minutes to two hours away. Talking to locals who have boats with their properties, they believe the million dollar coverage through airbnb will cover anything that happens, but a paralegal friend told me she thought not. We let some repeat guests talk us in to letting them use our old bayliner for a few days. They grounded out somewhere and absolutely trashed the prop. A friend around the point said the kid was driving and hit the flats. The renter denied it was them, and now I have to replace the prop so I am not keen on renting boats- just that so many here seem to expect it, so I was wondering what the broader experiences wee. You have all been very helpful!

Even if the so-called Airbnb coverage did cover the rental apartments/houses there is no way it would cover boats, kayaks or pedal boats.

Please please do reconsider. As I said above, our attorney (our paid-for, professional attorney and not a paralegal friend) said that we should not even offer bikes.

I know that the temptation is huge for you to supply boats for your guests but I’m sure that you can imagine some nightmare scenarios. Our rentals are waterfront and about once a month I get requests from guests who want to bring their own boats. Our dock is not included in our STR coverage so we can’t allow it. I’m going to guess that your STR coverage wouldn’t include kayaks or boats too.

Please tell your hosting friends that trying to fly under the radar as far as proper insurance and the largely fictitious Airbnb coverage is concerned is asking for trouble. One accident and they could lose everything. A damaged boat is the very least of their worries. Just the liability issues alone should be enough to stop them sleeping at night.

I wouldn’t let Airbnb collect payment for it. Besides Airbnb not being supportive of add-ons, things will get messy if there are problems with the rental. Would your insurance even allow you to rent out your boat? I find it highly unlikely they would cover any rental. Renting boats is not an impossible task because boat rental companies exist, but they have their own legal support.

The potential risk to you is very high and I would, as @Jefferson said, have a separate company with it’s own legal contract and insurance for the boat rental. This probably isn’t practical for one boat. Ideally, there’d be a company that you could use to rent your boat to specific people (like an Airbnb for boats). I know such a thing exists for RVs, but not sure about boats. Maybe talk with local boat rental companies, and see if they could handle transactions and insurance for a cut of the profit, but I honestly doubt they’ll be willing since they can buy used boats for peanuts.

I personally would do what @muddy said and just refer them to local boat rental places.

How to Charter a Boat

If you want to sail off into the sunset, at least temporarily, you need to understand how to get aboard first.

This time of year, it’s an inevitable thought: Life would be that much better out on the water. Specifically, on a boat.

Even if you have neither a boat nor boating experience, it’s never been easier to make your nautical dreams come true — whether you want a day trip on your local lake or a fully staffed multiday voyage in a far-flung locale. Here are the initial questions that will help you plan an adventure on the water.

Whom are you traveling with?

Thinking about the size and dynamic of your group is an important first step, even if you are simply going on a day trip. Will children be on board? How old? What about elderly parents?

Dan Lockyer, the chief commercial officer of Dream Yacht Worldwide , strongly encourages travelers to determine group size — and, ideally, get people committed — before booking.

“The location that you want to go to, the time of year that you want to go, the type of boat that you want will entirely depend on the makeup of the group that you’re sailing with,” Mr. Lockyer said.

Do you want to captain, or do you want a captain?

Different charter companies specialize in certain locations, types of boats, itineraries and services. Some companies offer the opportunity for a “bareboat” charter, in which you rent the boat and take on the navigation and provisioning yourself, while others exclusively offer fully staffed options, including a captain and a cook.

If you want to captain the boat yourself, almost all outfits require some kind of proof of sailing or boating experience, often in line with local regulations.

Edward King, 45, an executive at a streaming company based in San Francisco, is experienced in sailing the city’s waterways. But on vacation, he said he would prefer to let a captain and crew take the lead.

Mr. King said he appreciates a captain who is familiar with both the local waters — “they’ll know how to avoid sailing into a certain sandbar,” he said, — as well as the local attractions.

In contrast, Matt Blake, 38, a software engineer based in Oakland, Calif., was eager to grow his sailing experience during a recent trip to La Paz, Mexico, with his fiancée. He hired a captain but made clear that the captain was there to help and teach.

Where do you want to go?

“Do you want something that’s more culturally oriented? Nature oriented? An adventure trip?” asked Mary Curry, the voyage product director of Adventure Life , which offers small group tours and private trips on land and on water around the world.

That answer can determine your destination. Popular cruising grounds include the Caribbean, Croatia, Alaska and French Polynesia, but the sky — or the sea — is really the limit. For help narrowing your focus, travel advisers often have relationships with charter companies or outfits around the world, and sailing publications offer recommendations.

Kyla Malkani, who has had experience with charters working as a destination wedding planner, recommends consulting the concierge of waterfront hotels, particularly for short-term or day rentals.

“A lot of times they will have either their own fleet or they will have some sort of connection at a dock,” said Ms. Malkani, 37, who is based in Washington, D.C., and is currently working as a content creator and freelance event planner.

What kind of boat?

Where you want to travel and for how long will likely determine the kinds of boats that are available to you. Crucial at this point, too, is an understanding of the boat’s layout and amenities.

“You definitely want to choose the right kind of boat,” said Ms. Malkani. “If you want more adventure, a sailboat is nice. If you’re looking for a luxury party environment, a yacht is best. And if you’re looking for something smooth, for older people or with kids, a catamaran is great.”

David Barclay is a luxury travel adviser who has also chartered boats for his own vacations.

“You want to match what the travelers want to what the boat offers,” he said.

Perhaps a group of friends might not mind a catamaran with functional but not luxurious marine bathrooms, but a multigenerational group might prefer more high-touch amenities.

When should I book?

Often, charter trips are once-in-a-lifetime experiences that require a great deal of advanced planning.

“You may have a specific place you want to go, or a specific time of year you want to travel,” said Mr. Barclay. “And some places just aren’t good at certain times of year.”

Naturally, you don’t want to be at sea in the Caribbean during hurricane season, or in the Mediterranean during winter storms. But you also might want to avoid peak cruising seasons, too.

The first three weeks of August are quite popular, said Mr. Lockyer. “If you have some flexibility and can travel in early July, you’ll get the same sort of great weather, a greater selection of boats and the anchorages won’t be as crowded.”

How much does it cost?

Charter costs are incredibly variable, dependent on all of the factors coming into play: your boat type and size, your destination, your group size, the amount of crew you’d like and the amenities on board. That said, costs could range anywhere from $2,000 for a day on a sailboat to hundreds of thousands of dollars for a multiday mega-yacht charter. Have a budget in mind when beginning your research process.

What if I didn’t plan far in advance?

While advanced planning is encouraged, and often necessary for bigger boat trips, it’s possible to book a boat last-minute.

Boatsetter , an Airbnb-like platform for boats, is a good resource for last-minute bookings, especially for day trips, and even has an Instant Book option for down-to-the-wire bookings.

“If it’s for a special event, or around major holidays, you may want to book a month or two in advance. But for general bookings, you can find options within a week or two,” said Kim Koditek, Boatsetter’s head of brand strategy and communications, of the company’s overnight offerings, which appear on their platform under the luxury yacht charters category .

Ms. Malkani has used Boatsetter for some of her charters, most of which have been booked with a specific goal in mind.

“I’m a sunset chaser,” she said. “My husband and I just really love being on the water, and we always try to squeeze in some sort of boat day activity when we’re traveling.”

Vlad Yurov built an online following by teaching people how to get into the short-term rental business. He touted himself as a “seven-figure Airbnb host” who could help others quit their day jobs and get into the industry. 

“Real estate made the most millionaires in history,” Yurov said on his website, Vladbnb.com. “And you can become one too.” 

But the Los Angeles-based entrepreneur was allegedly listing properties on Airbnb illegally, and providing false addresses to guests, according to a lawsuit filed by the City of Los Angeles earlier this month. 

“These defendants exacerbated our housing crisis by leasing at least 30 apartments and houses from their owners and illegally renting them out as short-term rentals,” L.A. City Attorney Hydee Feldstein-Soto said in a statement, adding the fraud was committed on a “massive scale.” 

The city is suing Yurov, two business partners Anastasiia Medvedeva and Mari Meladze Nagi, and two associated businesses for violating the city’s short-term rental ordinance. LAist previously reported on the lawsuit. 

The ordinance blocks people from renting out rent-stabilized units for 30 consecutive days or less. In the city of Los Angeles, any rental unit built before October 1978 is rent-stabilized — rents can only be raised between 4 and 8 percent per year, based on the Consumer Price Index.

In court records, Yurov’s company Skysun Living denied the firm violated the short-term rental ordinance, and denied that the ordinance was even applicable. Skysun had asked a court to declare that the company had a “right to operate short-term rentals in the city of Los Angeles.” 

Yurov did not respond to a request for comment. His website, plus social media accounts, have been deactivated since the filing.

Yurov started his short-term rental operation in 2018, according to court records. 

He never owned units, but leased them on a long-term basis, according to the city attorney’s office. Since 2020, the city alleges, Yurov and his businesses have advertised more than 30 units across the city — 10 of which fall under L.A.’s rent stabilization rules. 

One of the units was rented for 170 days over a six-month period last year, the lawsuit says, making it impossible that Yurov or his business partners lived there. 

Often, the apartments were advertised as located in desirable L.A. neighborhoods — on the water in Marina del Rey, for example. But, the city alleges, guests were then given new addresses once the bookings went through. 

For example, a city investigator booked a stay at 4201 Via Marina in Marina del Rey. After the booking went through, however, the “true” address was revealed to be 415 Washington Boulevard, a rent-stabilized building closer to Venice. 

The defendants rented “multiple units” at the building, called Marina Tower, “without the landlord’s consent and in violation of their leases’ prohibitions on subletting.”

Yurov and his businesses had a plan for getting around that, the city alleges. 

“Knowing that Marina Tower prohibited tenants from short-term renting their units on Airbnb, defendants’ instructions warn guests “Do not knock on the leasing office. They can cause you problems,” the city states in its complaint.

No room for privacy: How Airbnb fails to protect guests from hidden cameras

It was another lawsuit brought by another victim whose fun-filled vacation turned into a voyeuristic nightmare: A woman was secretly recorded undressing at a rental property, her images stored on the computer of an alleged sexual predator accused of spying on unsuspecting renters for years.

Airbnb, one of the world’s largest short-term rental companies, had seen this sort of scenario before. Typically, the company seeks to settle hidden camera cases quickly and confidentially.

But this one played out differently.

An Airbnb representative testifying at a court-ordered deposition early last year offered a rare glimpse of the company’s hidden camera problem: Airbnb has generated tens of thousands of customer support tickets related to surveillance devices in the last decade.

During the hours-long deposition, the Airbnb employee also revealed that when a guest complains of a hidden camera, the company doesn’t – as a matter of practice – notify law enforcement, not even when a child is involved. The company may, however, reach out to hosts about complaints as part of internal inquiries – a move law enforcement experts say could hinder criminal investigations because it gives suspects time to destroy evidence.

A CNN investigation found that Airbnb consistently fails to protect its guests despite knowing hidden cameras are a persistent concern within its industry. Airbnb’s corporate strategies, moreover, have been aimed at preventing regulation of the short-term rental market to allow the company to distance itself from responsibility for guest safety and privacy.

Thousands of images have been recovered from short-term rental hosts by law enforcement. Hidden cameras placed in bedrooms and bathrooms show guests during their most private moments – changing clothes, being with their children, even having sex, according to CNN’s review of court and police records, as well as interviews with nearly two dozen guests who found surveillance devices at short-term rental properties or were told by police they had been secretly recorded.

Victims say they live under a shadow of fear that those private moments will become internet fodder.

“This is not my Social Security number or my email address. This is my naked body,” said one woman whose host secretly recorded her having sex with her husband at a cottage in Texas.

Airbnb declined CNN’s request for an interview. However, in a written statement, a spokesperson said that hidden camera complaints are rare, but when they do occur “we take appropriate, swift action, which can include removing hosts and listings that violate the policy.”

The spokesperson added that “Airbnb’s trust and safety policies lead the vacation rental industry and include background checks on US-based hosts and guests.”

CNN found that some of the policies touted by Airbnb come with significant disclaimers.

The company’s website, for example, tells users they should not rely on its background checks to identify “all past criminal convictions or sex offender registrations … or other red flags.”

And even if Airbnb discovers a user has a criminal background, convictions of “murder, terrorism, rape or child molestation” are not automatic disqualifiers under the company’s policy.

‘The Wild West’

Brian Chesky was unemployed when he and his roommate came up with the idea for Airbnb in 2007 while struggling to make rent in San Francisco. For $80 a night, they opened their home to three travelers, offering them air mattresses, breakfast and Wi-Fi. They called their start-up Air Bed and Breakfast. Thirteen years later, the company went public in the largest IPO of 2020, with a valuation of $47 billion.

Today, Airbnb – which is valued higher than Hyatt Hotels Corporation and Marriott International combined – continues to chase the benefits of being an international hotel chain while shouldering few of the costs or responsibilities.

Unlike hotels, Airbnb doesn’t control the properties it advertises or employ on-site staff such as security guards, receptionists or cleaning professionals. Instead, it leaves the costs of maintaining and protecting short-term rentals to hosts.

And, while hotels can be held legally responsible for guests harmed on their property, Airbnb frequently is not. In fact, Airbnb has fought against such liability in court, arguing it has little control over what happens at its listings – despite collecting roughly 17% of each booking.

The multi-billion-dollar short-term rental industry paints a rosy picture with advertisements highlighting how home sharing improves human connection and offers intimate, private spaces for busy travelers.

Still, violent crime and prostitution, as well as traveler deaths, have repeatedly forced Airbnb and its competitors into the international spotlight.

One security concern, which has gone largely unchecked by Airbnb and the rest of the short-term rental market, is hidden cameras. Airbnb has known about the problem for at least a decade and has repeatedly notified its shareholders of the issue in annual reports since the company went public.

“We were aware of it, there were an abundance of cases coming in,” said one former Airbnb employee who asked to remain anonymous due to a non-disclosure agreement with the company. The employee, whose team dealt with safety and privacy issues, said hidden cameras were among the group’s top concerns.

Despite those concerns, the company for years allowed video surveillance by hosts in common areas, if the cameras were disclosed to guests.

Chloe LeBrument, who traveled to London, Ontario, last summer with her fiancé for a music festival, found a camera hidden in a charger in the bedroom at an Airbnb rental.

“I’m sure there’s many, many people that have left the room having no idea that … they had been recorded,” said LeBrument, whose host has been criminally charged with voyeurism. LeBrument described feeling angry and disappointed by the experience.

“It felt really gross,” she said.

In January, CNN began reaching out to former Airbnb employees to ask about hidden camera concerns within the industry. In early March, Saturday Night Live mocked how ubiquitous the issue is in a skit. Just over a week later, the company announced it would ban all indoor cameras as of April 30. The company said nothing about how it would force hosts to comply with the rules.

“You can have all these great rules, but if no one’s checking that the rules are being followed … it’s still kind of the Wild West,” said attorney Bianca Zuniga-Goldwater, who represents several hidden camera victims in suits against Airbnb and Vrbo.

CNN reviewed more than a dozen police investigations and lawsuits across the US involving at least 75 victims and found Airbnb often moves swiftly to contain user complaints and resolve them out of court.

One attorney told CNN that Airbnb settled during a phone call after she gave them a heads up that she was going to file a lawsuit on behalf of a guest who said they found a camera hidden in their room at an Airbnb rental.

Airbnb seeks to compel complainants into arbitration, a process that hides cases from public view, according to six attorneys who represented clients in cases against the short-term rental platform. When a settlement is reached, Airbnb has required users to sign confidentiality agreements, which bar them from discussing details of the deal.

Airbnb told CNN its use of arbitration and non-disclosure agreements are standard practices within the industry.

One man, who was recorded having sex with his wife at an Airbnb rental and received a financial settlement from the company, said he felt “dirty” signing a confidentiality agreement. “We were gagged,” he said.

Last year’s court-ordered deposition, which was part of an ongoing case against Airbnb and has not previously been reported, should have detailed the scope of the company’s hidden camera problem.

The company, through its representative, was supposed to comply with a court order to quantify how many complaints or reports had been made to Airbnb by people who had been recorded by surveillance devices since December 1, 2013.

The Airbnb representative came to the table with a number. Her testimony revealed the company generated 35,000 customer support tickets about surveillance devices in the preceding decade.

In the deposition, the Airbnb representative sought to downplay the significance of the number of tickets, testifying they could reflect instances such as a malfunctioning doorbell camera or a tablet with recording capabilities left out on a coffee table. The representative did not provide any statistics detailing the number of claims she suggested were innocuous among the 35,000 tickets.

The Airbnb spokesperson told CNN that a single report could create multiple tickets. The company declined to specify how many unique complaints there have been.

CNN reached out to more than 130 former employees who handled safety issues or fielded security concerns for Airbnb’s support line. Of the 24 who responded, nearly half said they couldn’t speak about their experience due to non-disclosure agreements with the company. The few who agreed to be interviewed said one of the most common concerns they heard came from guests who feared they were being surreptitiously recorded.

“I’ve never received a call about a doorbell,” one former employee said.

‘The scariest moment of my life’ in Comfort, Texas

David Wyzynajtys and his girlfriend had never used Airbnb before booking a romantic weekend away in July 2021. When the couple spotted a remote property in Texas Hill Country with numerous positive reviews and a host who had earned Airbnb’s coveted “superhost” status, they booked it.

But after the pair arrived at the cottage in Comfort, Texas, and changed for the night, Wyzynajtys noticed something that terrified him: a hidden camera plugged into the wall and pointed directly at the bed.

“The scariest moment of my life,” Wyzynajtys recalled.

Wyzynajtys and his partner frantically left the property and drove nearly 10 miles down a dark, winding road to check into a hotel. Rattled, they reached out to Airbnb via a customer support chat feature asking that someone call them.

No one did.

Instead, the couple received an in-app chat message from Airbnb later that night.

According to court records, an Airbnb representative sought permission to report their complaint to the host, a man named A. Jay Allee. “Do you mind if we contact the host and get his side of the story?” Wyzynajtys recalled the Airbnb representative asking in the message.

The couple was fearful of Allee – they worried he could have been watching them through a livestream as they discovered the device and hurried to leave. Wanting to avoid a confrontation, Wyzynajtys denied Airbnb’s request.

Wyzynajtys said Airbnb was “totally just negligent or didn’t care about it at all.”

The next day, Wyzynajtys contacted law enforcement.

Police obtained a search warrant and raided Allee’s property, confiscating cell phones, computers, and the camera, which Allee had been using to record guests for much of a year. Among the more than 2,000 recovered images, law enforcement identified more than 30 victims, including several children. Many guests – who booked the same property either through Airbnb or Vrbo – were captured in various stages of undress. Some were recorded having sex.

Allee was later charged with 15 counts of invasive visual recording and pleaded guilty to six of them.

Thirteen people who stayed at Allee’s cottage – including two minors – sued Airbnb in California state court in July 2022. Airbnb settled with the plaintiffs six months later. A suit against Vrbo, filed by three couples who stayed at Allee’s property and were all recorded being intimate with their partners, is ongoing.

Allee held Airbnb’s superhost status. The rank, which is granted by the company’s algorithm, provides higher visibility and earning potential, according to Airbnb’s website. On Vrbo’s platform, he was similarly designated as a “premier host.”

One of Allee’s victims said that superhost status was one of the reasons he and his family had chosen the property for their weekend away.

“It kind of infers that a lot of people have good experiences there,” said the victim, who asked not to be named due to privacy concerns.

Some victims who spoke to CNN left positive reviews for stays – thus feeding the algorithm for a host’s elevated status – only to later learn from law enforcement they had been secretly recorded.

“Thank you for sharing your beautiful ranch with us,” one of Allee’s victims, who was recorded having sex with his partner, wrote in a Vrbo review after their stay in 2020. “We had an amazing time for our anniversary. We enjoyed feeding the animals and sitting by the fire at night just enjoying the silence. We will stay here again!”

A Vrbo spokesperson noted the company prohibits any cameras that capture the inside of a property and that “trust and safety are part of Vrbo’s legacy.” Vrbo didn’t respond to questions about Allee or its policies.

Lt. Butch Matjeka of the Kendall County Sheriff’s Office notified Airbnb of his investigation into Allee in October 2021, police records show. Almost two months later – and five months after Wyzynajtys found the camera – Allee’s listing remained active on Airbnb’s site, according to a lawsuit against the company.

“From a law enforcement perspective, if I tell you that I’m investigating then you should stop hosting that individual on your site until the outcome of my investigation,” Matjeka said.

Regulations are ‘bad for business’

Earlier this year, lawmakers in the European Union agreed to groundbreaking regulations governing the short-term rental industry. The new rules will require host registration, data sharing by the company and quality control of listings. Airbnb hailed the regulations as a “watershed moment” for the industry and praised the EU-wide approach.

Its public praise belies the fact that Airbnb has fought European cities for attempting to regulate the industry, said Kim van Sparrentak, a member of the European Parliament, who steered the legislation through the governing body.

“Airbnb is similar to other sharing economy companies – on a municipal level that means filing lawsuits as soon as any regulation is proposed,” she said, referring to the company’s strategy of fighting regulations in court.

There are no similar federal regulations in the United States.

Instead, local municipalities have been left to govern the fast-growing industry. In the cities that have been successful in introducing regulations – such as requiring hosts to register with local authorities – it has, at times, been difficult to get Airbnb to comply. Some of those regulations could assist with criminal investigations.

When the city of New York enacted a law last year that requires hosts to register with the city and prohibits platforms from processing transactions for hosts that fail to comply, Airbnb responded by filing a lawsuit calling the measures “extreme and oppressive” and said the restrictions would cause the company “irreparable harm.”

“It’s bad for business for them to follow regulations,” said Murray Cox, who runs the nonprofit watchdog organization Inside Airbnb. Complying with rules, he said, often means excluding business from Airbnb’s platform, which cuts into the company’s bottom line. “It’s about corporate greed.”

Airbnb’s legal weapon of choice in its fight against regulations – and in at least one case against a guest who claimed she was injured while staying at an Airbnb rental – stems from a decades-old law known as Section 230 of the Communications Decency Act . The law, often propped up as a defense by tech giants such as Facebook and X, states the platforms cannot be held responsible for user-posted content.

But for Airbnb, the argument has not always been successful. The judge presiding over the New York case, for example, pointed out that this legal protection didn’t apply to Airbnb because the company makes money on booking transactions.

“They say that if you’re going to participate in the transaction, then (Section 230) is off the table,” said Cox.

To Shannon Schott, a Florida-based attorney who settled with Airbnb after her client said he found a hidden camera at his rental, Airbnb’s use of Section 230 should be concerning to users who value their privacy and safety.

“They’re not arguing: This didn’t happen, your client isn’t injured. They’re arguing: We aren’t responsible,” Schott said.

Illinois Rep. Jan Schakowsky, who has introduced legislation that aims to curb big technology companies’ use of Section 230, argued that the platform would be safer if Airbnb were forced to take responsibility for what happens at its listings.

Right now, Section 230 is used as a “get out of jail free card,” the Democratic lawmaker said.

Broken promises

Less than 20 miles from Airbnb’s San Francisco headquarters, a 2019 Halloween party turned deadly at a rental property in California’s wealthy Orinda community. People fled as shots rang out, and when the dust had settled, five people were dead. The crime remains unsolved.

The carnage prompted Airbnb to re-examine parts of its business model, cracking down on party homes and vowing to verify all listings and user identities.

“Every home and every host on Airbnb will be reviewed with the objective of 100% verification” by the end of 2020, Chesky, the company’s CEO, promised after the shooting.

In March , Airbnb disclosed only about 20% of its property listings worldwide had been verified. However, the company has boasted that every host, co-host and booking guest is identity-verified. That accomplishment comes with a big disclaimer: Its identity verification badge “does not guarantee that someone is who they claim to be,” the company’s website states.

Nor does Airbnb’s identify verification process necessarily uncover a user’s criminal history. Earlier this year, Airbnb guests in the outskirts of Melbourne, Australia, were shocked to learn their host, with whom they shared their rental home, was a registered sex offender. According to a local news report that reviewed the listing at the time, Airbnb had verified the identity of the host. However, the identification process didn’t appear to surface the 11 charges of sexual assault on a mentally disabled person – for which the host spent more than four years in prison. Airbnb told the news outlet it suspended the host’s account after it learned of the criminal conviction.

Background checks appear to go beyond identity verification and involve searching public databases for users’ information. The checks, which Airbnb says are conducted by a third party, could notify the company of users’ criminal histories. However, the company makes no guarantees to perform them on every user worldwide. On its website, Airbnb says it may run a background check if it has at least a first name, last name and date of birth for US-based users who create listings.

Still, the company warns travelers they shouldn’t rely on its background checks to uncover all convictions, sex offender registrations or other red flags for its users.

‘Digital content is forever’

Allee was released from jail in February following a one-year sentence. His attorney didn’t respond to requests for comment.

Police identified more than 30 suspected victims who stayed at Allee’s cottage but could only file charges in connection with 15.

To some of those victims, his brief stint behind bars didn’t suit the crime.

“Less than a month for every victim,” said Wyzynajtys, the guest who found Allee’s hidden camera.

However, Allee’s lenient sentence was not unusual. In most states, and on the federal level, video voyeurism is a misdemeanor, punishable by no more than a year behind bars.

In 2022, Airbnb superhost Peter Madden pleaded guilty to seven counts of violation of privacy in connection with recording five guests at his property in Maine, according to the Cumberland County District Attorney.

During an interview with police, Madden initially denied ownership of the camera, which was concealed in a clock radio and pointed at his guests’ bed. Then, he said he put it there for security reasons. Ultimately, Madden, whose attorney didn’t respond to CNN’s requests for comment, admitted he’d been recording guests engaged in sexual activity.

“There’s stuff of a couple of couples playing around or getting changed,” he conceded when pressed by an officer about what images the camera captured.

“Are you a voyeur?” the officer asked, according to a recording obtained by CNN. In response, Madden laughed.

“I’m an artist,” he said. “I look at everything, I study everything.”

Madden served 14 days behind bars.

Victims, on the other hand, suffer lengthier consequences.

All of Allee’s victims who spoke with CNN, seven in total, said they suffered long-term trauma due to Allee’s actions. They also detailed the crippling fear that their images – or those of their kids – will one day end up online, if they haven’t already.

“What is made into digital content is forever,” said the woman who was secretly recorded having sex with her husband at Allee’s cottage.

An intensive care nurse who visited Allee’s property at the height of the Covid-19 pandemic continues to suffer from “social distress around the personal nature of the recordings and the possibility that they will become public,” according to the lawsuit she filed against Vrbo. Several images on Allee’s computer showed the nurse undressed and being intimate with her husband. Others captured her infant son, police records show. Vrbo didn’t respond to CNN’s inquiries about the case.

One couple – who stayed there to celebrate an anniversary – said they felt “shocked and appalled” by the experience and worried that strangers had seen images of their private moments. One woman said she now takes medication to treat feelings of paranoia.
